Mediation is often a more effective way to resolve disputes than lawsuits. This lecture will describe how mediation is practiced in the US. Topics will include the timing of when to initiate mediation, the role of the mediator, selecting a mediator, how mediations are conducted, confidentiality, mediation briefs, the life cycle of a mediation, ensuring a binding settlement, and skills and techniques to use in a mediation.

In most US criminal and civil trials, factual matters are decided by a jury of lay persons. This lecture will describe how a jury trial progresses, and the skills and techniques the lawyer should use in presenting the case to a jury. The lecture will cover preparing for a jury trial, opening statements, direct and cross examination of witnesses, closing argument, the differing roles of the jury and the judge, and handling evidentiary objections.
