SaaS CoC v1 Public Consultation
The SWIPO WG seeks to elicit public feedback on the current state of the Software-as-a-Service Code of Conduct document. This document is not standing on its own; it forms part of a set of documents that are shared with other Codes of Conduct agreements developed in this Working Group:

1. The CoC Governance document – Rules of enforcement, complaint, and governance body structure
2. Common high-level principles – Fundamental principles and mechanics of the Codes
3. Terminology – A set of terms and definitions common to all Codes of Conduct developed in this Working Group
4. Legal aspects – Legal conditions and requirements to be observed when negotiating, entering into, and terminating contractual relationships with cloud service providers

All four shared documents are currently drafted albeit in advanced state. The Working Group will seek public opinion on all four once they are considered a final Working Group draft.


This public consultation opens on 6 December 2018 and ends on 31 January 24:00 CET.

Read the SaaS Code of Conduct carefully, and begin filling out the response document downloaded earlier.
If applicable, circulate both together among your colleagues for collated input using your organisation's internal review collection process(es).

This form, and the public consultation response form, collect certain personal information from you, the submitter, and any information you decide to share by filling out the public consultation response document, and this electronic form.
The public consultation performed through this form is performed by the SWIPO Working Group (short: SWIPO; for further information please see: https://ec.europa.eu/digital-single-market/en/news/cloud-stakeholder-working-groups-start-their-work-cloud-switching-and-cloud-security). SWIPO is the controller of the personal data obtained and processed while performing this public consultation and afterwards.
The data collected and processed are your email-address and any information you provide when using the form.
The information collected will be used by SWIPO for the following purposes:
1. Identification and verification of the person/institution participating in the public consultation, e.g. in order to prevent abuse of the form and the consultation process;
2. further development of the Code of Conduct which was commented on and any other Code of Conduct developed by SWIPO;
3. communication with the submitter in case questions related to the topics described above arise;
4. Assessment on how far and which sectors this consultation reaches in order to optimise future outreach and exposure of similar public consultations.
5. Archiving and transparency measures in order to prove the credibility of the public consultation process.
For purpose (2), the legal basis of the processing is Art. 6 1. Lit. b) GDPR: For all other purposes mentioned above, the legal basis of the processing is Art. 6 1. Lit. f) GDPR (Legitimate interest: Performance of the work of SWIPO). For the legal basis of the data processed by Google LLC, please see the abovementioned privacy statement of Google. For any purposes related to Art. 6 1. Lit. f) GDPR, you have the right to object pursuant to - and in consideration of the requirements of - Art. 21 GDPR.
Your personal information will be kept and processed by us for the duration of this public consultation and afterwards until all the purposes described above are fulfilled. This will be the case latest when the work of SWIPO and any related projects is fully completed. In case you exercise your right to object (Art. 21 GDPR), the data related to the performance of this right will be deleted immediately.
