I am the parent or legal guardian of the above named student (the “Student”). In consideration of the Student’s participation in Mount Tamalpais School’s athletics program during the 2026-2027 school year 8/26/2026 to 6/4/2026, including transportation to and from such activities (“School Athletics”), and as a condition thereof, I am signing this Athletics Liability Release (this “Release”) on behalf of myself and the Student. This Release is made in favor of Mount Tamalpais School, a California nonprofit corporation (the “School”), and its trustees, officers, employees, representatives, and agents (the School and all such persons are collectively referred to as the “School Released Parties”).
On behalf of myself and the Student, I acknowledge and agree as follows:
1. Consent for School Athletics and Vehicle Transportation.
The School offers opportunities for students to participate in School Athletics. School Athletics may involve transportation by school van or private vehicles driven and owned by individual faculty, staff or parents/legal guardians of other students, vehicles owned, leased or contracted by the School, public transportation or walking. I give my permission for the Student to participate in School Athletics, including, if applicable, transportation in connection with School Athletics, for the 2026-2027 school year.
2. Acknowledgment and Assumption of Risk; Voluntary Participation.
The Student and I are aware and understand that there are many risks and hazards inherent in School Athletics and that these risks and hazards cannot be eliminated, altered, or controlled regardless of the care used, the skill or experience possessed, or the precautions taken by me, the Student or anyone else, including the School or other School Released Parties.
The Student and I are aware that the Student’s participation in School Athletics may involve transportation-related accidents, and, depending on the sport, physical exertion, objects traveling at high speed, equipment malfunction, quick movements and changes of speed, loss of balance, difficulty or inability to control speed and direction, physical contact between participants, and physical contact between participants and other individuals and objects, including, but not limited to, athletic equipment and structures related to the athletic activity.
The Student and I understand that the Student’s participation in School Athletics may result in, depending on the sport, strains, sprains, scrapes, bruises, joint inflammation, fractures, concussions, dislocations , dehydration, cramping, eye injury, back injury, heat exhaustion, and other physical and/or psychological injury , including but not limited to serious, permanent bodily injury, paralysis, illness and/or death, and/or damage to my, the Student’s or others’ belongings. The Student and I voluntarily elect, with knowledge of the risks involved, for the Student to participate in School Athletics.
The Student and I accept and assume any and all risks, damages, and hazards associated, directly or indirectly, with the Student’s participation in School Athletics, whether known or unknown, whether caused by the action, inaction or active or passive negligence of me, the Student, the School, any of the other School Released Parties , or otherwise (all such risks, damages, and hazards, including, but not limited to, those described in this Paragraph 2, are collectively referred to as the “Risks and Losses”).
3. Liability Release.
The Student and I agree not to make a claim against or sue the School Released Parties for , and the Student and I release, forever discharge, and will hold harmless the School Released Parties, and each of them, from and against any and all claims, actions, demands, rights, causes of action, losses, liabilities, costs and expenses, including attorneys’ fees (all such claims and liabilities are collectively referred to as the “Claims ”), arising from or in connection with any of the Risks and Losses that may actually be sustained or suffered by me, the Student or by any other person as a direct or indirect consequence of the Student’s participation in School Athletics, whether caused by the action, inaction or active or passive negligence of me, the Student, any of the School Released Parties, any third parties, or otherwise; provided, however, that this Release does not apply to liability for gross negligence, willful injury or fraud.
4. Insurance.
I understand that all participants in School Athletics must be insured for medical and hospital expenses and confirm that the Student is so insured. I further acknowledge that such insurance is primary and noncontributory to any insurance that the School may carry.
5. Miscellaneous.
If any term or provision of this Release is determined to be illegal, unenforceable, or invalid in whole or in part for any reason, such provision shall not affect the legality, enforceability, or validity of any other provision of this Release and such provision shall be reformed and construed so that it will be legal, enforceable, and valid to the maximum extent permitted by law. This Release will survive the completion of the Student’s participation in School Athletics and will continue in full force and effect thereafter.
I have read this Release carefully and fully understand all its terms and provisions. I have knowingly and voluntarily executed and delivered this Release understanding the risks to me and the Student and have done so of my own free will, without relying on any statement or representation of any of the School Released Parties.
I understand that this is the entire agreement between the undersigned and the School Released Parties with respect to the subject matter hereof and that that this agreement cannot be modified or changed in any way by oral statements by any of the School Released Parties or by the Student or me.
I understand that, in the event of any litigation against the School Released Parties, this Release may be raised as a defense and bar to, and as a waiver and release of, legal rights that might otherwise be asserted by me, the Student or any of the Student’s heirs, assigns, personal representatives or survivors.
