Demand District Attorney O'Malley to Change Her Legacy!
In Alameda County, Black and Brown people make up an overwhelming two-thirds of the people incarcerated in Santa Rita Jail. This is also true for the Alameda County Juvenile Justice system in which Black and Brown youth make up 87% of those in probation and detention.
These numbers tell us that incarceration is happening disproportionately to Black and Brown youth and adults. A great deal of work is needed to remedy this and to create a more equitable society. Opportunities for rehabilitation and transformation are often unattainable for low income Black and Brown communities. In the final months of DA Nancy O'Malley's tenure, she has the opportunity to make a huge impact and leave behind a legacy by working alongside advocates to set things on the right course.
In the final month's in office, District Attorney O'Malley can immediately:
1. Reduce the population at Santa Rita Jail
Release all people on pretrial
Reduce the general jail population by 50% by 2023
2. Ensure compliance with emergency bail schedule
End the practice of objecting to emergency bail schedule
3. Establish a decline to charge policy that diverts low level and misdemeanor offenses and ensure that people completely stay out of the system
4. Establish a policy to eliminate sentence enhancements
Eliminate 3-strikes
5. Establish a policy to end youth transfers to adult court
6. Create a list of people who will be prioritized for resentencing, in particular those serving life sentences, Life Without Parole (LWOP), Three Strikes convictions, people who are serving time on sentence enhancements, and those with mitigating factors that weren’t reviewed during initial sentencing.
7. Refine the certificate of rehabilitation process
8. Ensure people are receiving services under ab109
9. Expand police transparency and accountability efforts regarding police brutality, extra-judicial killings and political corruption.
Create or publish a “Do Not Call” list of officers who your office won’t call on to the stand
Instruct Deputy DA’s to review all body worn camera footage and all other evidence in cases of “resisting arrest”
10. Uphold transparency and publish crucial information such as the Brady list, sharing data in regards to charging practices and resentencing.
11. Establish a policy which institutionalizes a culture of meeting with community advocates who work with impacted communities such as the JRC
