WHEREAS < player name> (hereinafter called the “Releasor”), has been allowed to play as a player in and member of the GM SALARIED HOCKEY LEAGUE (hereinafter called “the League”.)

Wherever in this release the expression “the League” is used, it shall mean and include the League and all of its members, commissioners, directors, officers, employees, organizers and agents.

AND WHEREAS the Releasor acknowledges that the game of hockey played as a sport is a dangerous sport and that there are certain risks of injury inherent in the game itself, which risks of injury the Releasor is prepared to assume in order to be allowed to play as a member in the League.

AND WHEREAS the Releasor is entering into this Waiver and Release so as to allow the League to continue without risk of financial loss to the League and General Motors of Canada Ltd., its directors, officers, employees and agents (hereinafter called “GMSHL”), which the Releasor acknowledges is in his best interest due to his desire to have the League exist for the benefit of himself and others.

In consideration of the acceptance of this entry in the League, I, for myself, my heirs, executors, administrators and assigns, waive any claims to which I may become entitled for injury or damage and release the League, GMCL and all other organizers, sponsors, representatives, their agents and employee and any other person or organization assisting in this event from any claims for damages or injury suffered by me as a result of my participation in or traveling to or from this event. I further state that I am in proper physical condition to participate in this event and am aware that participation could in some circumstances result in physical injury.

AND FURTHER IN CONSIDERATION as aforesaid, the Releasor hereby agrees not to make any claim or to commence or maintain any action or proceeding against any person or corporation in which any claims could arise against the League or GMCL for contribution or indemnity under the Negligence Act otherwise.

AND FURTHER IN CONSIDERATION as aforesaid, the Releasor hereby covenants and agrees to indemnify and save harmless the League and GMCL, against and from all actions, damages, debts, accounts, claims and demands which may hereafter be brought against the League or GMCL, by or on behalf of any person whatsoever, where the cause leading to such action, damage debt, account, claim or demand was a cause which arose as a result of some activity of the Releasor herein.

The Releasor acknowledges that this release relates to any injury or loss sustained by himself or his employees, agents or family members, howsoever caused and whether or not due to any act or omission amounts to breach of contract, or negligence.

The Releasor acknowledges having read, and acknowledges his understanding of this waiver and release prior to the execution of same. The Releasor further acknowledges having been advised that he has full opportunity to obtain independent legal advice as to the terms and effect of this Release prior to the execution of same.
