In consideration of the participation of the Participant in the Class at the Location(s), the Participant and where the Participant is a minor, the Participant’s parent or legal guardian (collectively the “Releasors”), hereby agree as follows:

1. The Releasors acknowledge and agree that the Participant’s participation in the Class is purely voluntary.

2. The Releasors are aware of and understand the inherent risks, dangers, and hazards of the Class and the Participant’s participation therein and the potential for personal injury, death, property damage and/or loss which exists in connection therewith. The Releasors hereby freely accept and assume all such risks of personal injury or death or damage to or loss of property. The Releasors freely accept and assume all risks of the Participant’s participation in activities such as, but not limited to: ice hockey, skating, on-ice games, ball hockey, soccer, dodgeball, volleyball, off-ice conditioning, yoga, stretching, plyometrics, sprinting, strength training, kickball, ultimate frisbee, tag, and off-ice teambuilding games.

3. The Releasors agree to abide by the rules and regulations of the Location(s) and agree to use the Location(s) and equipment in a manner consistent with their intended use and application (or where the Participant is a minor, the parent /or legal guardian agrees to acquaint the Participant with the rules and regulations of the Location(s) and ensure that the Participant uses the Location(s) and equipment in a manner consistent with their intended use and application).

4. The Releasors agree TO WAIVE ANY AND ALL CLAIMS against each and every one of, Capital Sports Management Inc. (“CSMI”), the owner(s) of the Location(s), Capital Sports & Entertainment Inc. (the Ottawa Senators), third-party operators at the Location(s), the National Hockey League (“NHL”), the NHL Member Clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., the NHLPA and current and former players, and each of their respective affiliates, parents, and related entities, as well as the owners, governors, officers, directors, partners, partnerships, principals, employees, agents, representatives, volunteers, sponsors, promoters, and advertisers of all the foregoing, and the organizers, promoters, sponsors, suppliers and advertisers of the Class (collectively the “Releasees”), and to REMISE, RELEASE AND FOREVER DISCHARGE EACH AND EVERY ONE OF THE RELEASEES from any and all demands, losses, claims, costs, damages, expenses and liabilities for any loss, damage, expense or injury, including death, that the Releasors may suffer, directly or indirectly arising out of or as a result of or relating in any manner whatsoever to the Participant’s participation in the Class and/or presence at the Location(s), howsoever arising, including NEGLIGENCE, BREACH OF CONTRACT, BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OWED UNDER THE OCCUPIERS’ LIABILITY ACT (ONTARIO), ON THE PART OF ONE OR MORE OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE BY ONE OR MORE OF THE RELEASEES TO SAFEGUARD OR PROTECT THE PARTICIPANT FROM THE RISKS, DANGERS, AND HAZARDS OF THE CLASS (AS DEFINED ABOVE).

5. Each of the Releasors that is a parent or guardian agrees TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all actions, losses, claims, costs, damages, expenses and liabilities (including legal fees and court costs) which may be suffered or incurred by one or more of the Releasees arising out of or as a result of or relating in any manner whatsoever to any injury to persons (including injuries resulting in death) and/or loss of or damage to property, in connection with the participation of the Participant in the Class and/or presence at the Location(s), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

6. By participating in the Class, each of the Releasors acknowledge and grants permission that the Sensplex (or a third party engaged by the Sensplex for such purpose) may take photographs and/or videos, and broadcast video of me and/or my team while participating in the program and/or while in or around the Sensplex for the purpose of promoting and/or marketing the Sensplex and/or for resale purposes, without compensation other than allowing me to participate in the program: I waive all right (including intellectual property, copyright, and privacy) in connection therewith.

7. By participating in the Class, each of the Releasors grants its permission to use the Participant’s name, likeness or any other identification for advertising, marketing, publicity, instructional or other purposes in connection with the Class and/or the Location(s) and/or any related activity of any of the Releasees, in any medium, at any time and from time to time, without compensation and without right of prior review or approval by the Releasors (except where prohibited by law).

8. Where the Location, or one of the Locations, for the Class is the Cavanagh Sensplex, each of the Releasors consents to the collection by CSMI of his/her personal information on this Release and Indemnity and on the Class enrollment form and to the disclosure of such personal information by CSMI to the City of Ottawa and to third parties, as required, including legal and insurance companies, in each case to the extent permitted or required by applicable laws.

9. The Releasors acknowledge and agree that in all matters relating to the Class including the allocation of any prize, if applicable, the decision of CSMI shall be final and binding.

10. This Release and Indemnity shall enure to the benefit of the respective heirs, next of kin, executors, administrators, successors and assigns of the Releasees and shall be binding on each of the Releasors and their respective heirs, next of kin, executors, administrators, legal personal representatives, successors and assigns. This Release and Indemnity and any rights, duties and obligations as between the parties to this Release and Indemnity shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and no other jurisdiction. Any litigation involving the parties to this Release and Indemnity shall be brought solely within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province of Ontario. This Release and Indemnity is meant to be liberally construed to protect those entities and individuals listed above to the fullest extent allowed by law.

11. The Releasors acknowledge: having been given full opportunity to read this Release and Indemnity before signing it; having had full opportunity to ask any questions regarding the Class; and, having read and understood this Release and Indemnity (or where the Participant is a minor, having his/her parent or legal guardian read the Release and Indemnity and explain it to the Participant).

12. If this Release and Indemnity is not signed by all the Releasors, this Release and Indemnity shall nonetheless be a legal and binding obligation of each Releasor who has signed this Release and Indemnity.

REFUND & CANCELLATION POLICY:

Planning for all Sensplex camps and programs is based on current enrollment numbers well in advance of the camp/program start date. As a result no refunds or cancellations are permitted, except for medical reasons. If a player is unable to attend the camp/program (and notice is given prior to the program start date) due to medical reasons, he/she will receive a credit for their full amount paid less a $35 administration fee, which may be used for any camp/program taking place within the next one (1) full calendar year. A doctor's note is required to substantiate this type of cancellation, and this note must be provided within one week of notification. Please also note that credits issued are non-transferable
