Rental Agreement, Terms and Liability Waiver for Bad Apple Eddy Outfitters, LLC

Renter assumes and accepts liability for damage, injury, or death:
I hereby agree that by renting SUP(s), float tube(s), canoe(s), kayak(s), raft(s), or other equipment from Bad Apple Eddy Outfitters, LLC, I accept liability for any damages or injury that may occur to me or others in my group while using any of the equipment—regardless of its condition—rented from Bad Apple Eddy Outfitters, LLC. By signing this agreement I understand that I am waiving my right to bring a court action to recover compensation or to obtain any other remedy for any injury to myself, my property, or my death, however caused, arising out of my use of any equipment or programs of Bad Apple Eddy Outfitters, LLC. I understand that there are inherent risks associated with water sports, pulling a trailer, and transporting equipment on vehicles and trailers.
Renter assumes all risks and will replace damaged or lost equipment:
I understand that equipment and safety devices are provided for my use (such as flotation devices, etc.). I agree that I am solely responsible for proper and safe use of equipment and understand the hazards of water activities. It is my responsibility to inspect all equipment—including trailers, tires, light connections, chains, straps, and tire pressure prior to use. I, the undersigned user—or guardian of user—HEREBY RELEASE on behalf of myself, my heirs, representatives, successors, executors, and administrators of Bad Apple Eddy Outfitters, LLC, its officers, agents, and employees from any cause of action, claims, or demands of any nature whatsoever including, but not limited to, a claim of negligence. I also agree that if I damage, loose, or misplace any item I rent or use from Bad Apple Eddy Outfitters, LLC that I will pay for these losses or damages immediately. Lost or abandoned equipment will be billed $50 per hour plus expenses for recovery time, or billed to replace at 80% MSRP.
Renter is responsible for trailer connection, lights, and securing boats during transport:
I (renters) am responsible for connecting the trailer, lights, and chains properly and for securing all canoes, rafts, paddles, life jackets and other equipment to trailers or vehicles. I will double-check all straps and connections prior to driving. It is my responsibility as a renter of equipment to ensure that any required permission forms, trip permits, invasive species tags, boating permits, and trainings are completed and up to date prior to launching boats.
Renter authorizes Bad Apple Eddy Outfitters, LLC to charge card for damaged or replacement costs:
I authorized Bad Apple Eddy Outfitters, LLC to charge my credit card for any damage or replacement costs. Furthermore, I agree that if Bad Apple Eddy Outfitters, LLC incurs any costs associated with recovery of payment for damages or losses (such as court costs) that I will reimburse or pay Bad Apple Eddy Outfitters, LLC for these costs as well as the cost of the damaged or lost items. Bent paddles, folded (wrapped) canoes, and damaged stand up paddle boards (SUPs), float tubes, rafts, or other equipment will be charged for replacement. It is the sole discretion of Bad Apple Eddy Outfitters, LLC to determine if damaged equipment will be repaired or replaced at the renter’s expense.
I agree to:
- Have everyone wear a life jacket adjusted properly.
- Do not step on or stand in canoes, kayaks, or SUPs when they are on shore. Do not drag boats on the ground.
- Do not stand on black life jacket boxes, they are plastic and will break.
- Double check that all straps are secure before driving away.
- Double check trailer connections: chains, lights and hitch.
- When returning trailers, do not back trailer through the parking lot (pull in forward, we will move trailers with dolly after unhitching.)
- Canoes will not be used on the Logan River (except at 1st, 2nd or 3rd Dams) upstream of the shooting range on 200 North (Valley View Highway) or on the Bear River Oneida Narrows from the dam to Riverdale.
Rentals will be returned on time on the day of (or last day of) the rental, between 5 and 7 pm, as stated in the confirmation email, or other scheduled time as arranged with Bad Apple Eddy staff. All late returns will be charged a $15 late fee, additionally any returns over an hour late will be charged the full next day rental fee. The full rental fee may be charged when a late return results in the rental being unavailable for the next customer. It is the renters responsibility to make any and all effort to contact and communicate with Bad Apple Eddy staff of any delays, or changes. Bad Apple Eddy Outfitters, LLC reserves the right, at their discretion, to waive the late fee for extenuating circumstances.
I understand that the terms of this agreement are legally binding and I certify that I am signing this agreement on the reverse side of this page, after having carefully read it, of my own free will.
I have read and agree to honor the terms of this rental agreement.
