In consideration of being permitted to enter, use, and otherwise remain on the facilities located on 4107, Nixon Lane, Austin, Texas including all parking areas, playing fields, entryways, and other ancillary areas (collectively, the "Venue") for the purposes of participating in rugby activities, the undersigned participant or legal parent/guardian of the listed participant(s) (the “Participant”), hereby releases, waives, discharges Huns RFC, a Texas non-profit corporation  (the “Company”), its parents, subsidiaries or other affiliates, officers, agents, or employees (collectively the "Releases") from any and all liability, claims, demands, actions, and causes of action of any kind or nature arising out of or related to any loss, damage, or injury, including death, that the Participant may sustain while on the Venue during the Event, regardless of whether such loss is caused by the negligence of the Releases and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, and covenants not to sue the Releases based on the same.

The Participant is aware and understands that the Event may be dangerous and involves the risk of serious injury, death, or property damage. The Participant acknowledges that any injuries that the Participants sustain may be compounded by negligent emergency response or rescue operations. The Participant acknowledges that the Participants are knowingly and voluntarily participating in the Event with an express understanding of the danger involved and hereby agree to accept and assume any and all risks of injury, death, or property damage, whether caused by the negligence of the Company or otherwise.
The Participant assumes full responsibility for any risks of loss, property damage, or personal injury, including death, that its property or the Participant  may sustain while on the Venue during the Event, whether caused by the negligence of the Releasees or otherwise, including as a result of negligent rescue operations.

The Participant further covenants and agrees to indemnify and hold harmless the Released from any loss, liability, damage, or costs, including attorneys' fees and court costs, they may incur arising out of or related to the Participant’s use of the Venue during the Event, whether caused by the negligence of the Releasees or otherwise, including as a result of negligent rescue operations.

The Participant further covenants and agrees that this Release shall be construed in accordance with the laws of the State of Texas and that any mediation, suit, or other proceeding relating to this Release and any activities covered hereby must be filed or entered into only in Travis County, Texas. Any portion of this Release deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the Release as a whole to the full extent authorized by law.

The Participant hereby agrees that if any provision or part thereof contained in this Release is declared illegal, unenforceable, or ineffective, such provision or part thereof shall be deemed severable, such that all other provisions contained in this Release shall remain valid and binding.



IN WITNESS WHEREOF, and intending to be legally bound, each of the undersigned Parties hereto has caused this Release to be executed as of the date(s) set forth below.
