Affidavit of Death of Trustee Wizard
This form will guide you through filling out an Affidavit of Death of Trustee. The completed affidavit will be emailed to you. Be sure to proofread the affidavit before signing and recording to make sure it is correct and complete.
Before You Start
DEATH CERTIFICATE: You will need a certified copy of the death certificate. If you do not have one, you can obtain one from the Clerk/Recorder's office in the county where the decedent died.

CURRENT DEED: You will need the following information from the current deed:

1. Name(s) of the grantor(s) of the current deed.

2. Legal description of property (NOT the address). Example: "Lot 14 of Blackacre Addition to the City of Sacramento, as delineated on the map of said addition, recorded January 30, 1965, in Book 625, 013065."

If you do not have a copy of the current deed, you should obtain one from the County Recorder's office before you fill out this form. Most deeds are one to two pages and currently cost $1.00 per page.

TRUST DOCUMENTS: You will need the following information from the Trust documents: the date the trust was recorded and the names of the Trustors and Trustees.
