COVID-19 WAIVER/RELEASE

Each of the undersigned, on behalf of itself, themselves and each minor child of the undersigned, (collectively, the
“Participant”) has requested access as a guest to Union Sports Arena (located at 2441-A Route 22 West, Union, NJ
07083) and / or The Westfield Rink (located at 650 Fourth Ave, Westfield, NJ, 07090) (collectively, “USA/TWR”), which
are owned and operated by Union Sports Arena LLC and Arena Realty Partners, LLC (collectively referred to as
“Owner”). The Participant is voluntarily entering USA/TWR to utilize the facilities or participate in activities there. But for
signing this COVID-19 Waiver/Release, Owner would not grant Participant access to USA/TWR. Participant shall adhere
to all rules and instructions of entry and use of USA/TWR that may be expressed, posted or provided by or on behalf of
Owner (including any employee or representative) to Participant at any time prior to or during access to USA/TWR as
well as all applicable federal and state laws, ordinances, and regulations, including but not limited to proper separation
and social distancing.
Participant acknowledges that the State of New Jersey, including the cities/towns where USA/TWR are located, is
experiencing the COVID-19 pandemic (“COVID-19”). According to the Centers for Disease Control and Prevention

(“CDC”), COVID-19 is an extremely contagious respiratory disease and is believed to spread mainly from person-to-
person contact. Information and guidelines regarding use and access of facilities such as USA/TWR is changing and

being updated daily and it is the responsibility of the Participant to make informed choices and to take precautionary
measures to protect themself and others. More information is available at www.coronavirus.gov and
www.cdc.gov/coronavirus/2019 as well as through other local and national resources.
Participant hereby acknowledges that he/she is aware of COVID-19 and its symptoms, including, without limitation, fever,
cough, shortness of breath, muscle or body aches, headache, congestion or runny nose, sore throat, fatigue, nausea or
vomiting, new loss of smell or taste, or gastrointestinal problems. Participant further acknowledges that USA/TWR and
Owner cannot guarantee that Participant will not be exposed to and/or will not become infected with COVID-19, and that
such exposure to or contraction of Coronavirus may result in personal injury, illness, disability and/or death. Participant
further acknowledges that if he/she has a pre-existing health condition, exposure to COVID-19, or any other infectious
disease may be more likely to cause serious illness, injury, or death. Participant further acknowledges that other people,
including, but not limited to, Owner and its employees and guests, may enter USA/TWR prior to, at the same time as or
after Participant, which may increase the risk of exposure to COVID-19 by Participant. Owner has not and expressly
does not make and Participant is not relying upon any representation or warranty, expressed or implied, that USA/TWR
or any employees, patrons, guests or agents are free from COVID-19 or that any particular precautions, actions,
preventions or disinfecting has occurred or if it has, is or may not be completely effective in the prevention of COVID-19
or the exposure thereto.
Participant agrees not to enter USA/TWR if he/she has recently been diagnosed with, or tested positive for, COVID-19
or other symptoms of influenza-like illness, and has not been directed to self-quarantine by a licensed medical
professional, and shall promptly notify Owner (or an employee) of any such symptoms. Participant further acknowledges
that he/she does not have a household family member/roommate who has recently tested positive for or exhibited any
of the above-referenced symptoms of COVID-19. Participant acknowledges that he/she has not, nor have any
member(s) of his/her household, traveled by sea or by air, internationally, nor visited any area within the United States
that was reported to be highly affected by COVID-19, within the past 30 days.
Owner reserves the right to refuse entry by Participant based upon information received from Participant or upon
guidelines provided by governmental authorities, CDC, medical advisers or other industry recommendations or
governmental requirements or otherwise pursuant to its own guidelines, regulations or independent determination.
Participant hereby voluntarily acknowledges and assumes all risks related to COVID-19, to the fullest extent permitted
by law. Participant hereby waives, releases, covenants not to sue, discharges and agrees to indemnify, defend and hold
harmless Owner and each of its affiliates, partners, members, managers, employees, representatives and agents
(“Owner Parties”) for, from and against any and all liability, claims, causes of action, damages, losses, cost, expense,
illness, injuries, and death (“Claims”) arising out of or related to COVID-19 and/or the access to or use of USA/TWR by
Participant. Participant acknowledges and agrees that this waiver, release and indemnification acknowledgment
includes any and all Claims related to or arising from any actions or omissions (including the negligence of) by USA/TWR
and/or Owner.
If requested, prior to and as a condition of entering USA/TWR, Participant shall accurately and honestly complete,
execute and deliver a Self-Health Assessment form or statement related to COVID-19 as provided by Owner and
acknowledges that Owner is relying on the information provided in the health disclosure in granting such access.
