Requirements for Open Burning

  1.  Open burning general rules.
  2.    A)   Burning household refuse is NOT allowed:
  3.            i. Within the City limits of Ozark and Fremont Hills.
  4.    B)    All burning shall take place on the owner's property.
  5.    C)    No burning on City right of way within City limits of Ozark
  6.    D)   Items NOT ALLOWED for burning:
  7.          i.          Petroleum-based products (e.g., tires, shingles, carpets, used oils, etc.)
  8.          ii.         Durable goods (e.g., furniture, appliances, items not single-use, etc.)
  9.          iii.        Construction, Demolition, or trade waste, except for untreated wood (e.g., treated lumber, plywood, particleboard, chipboard, wood with other than minimal quantities of paint, coating, or finish, etc.)
  10.          iv.        Salvage operation waste.
  11.          v.         Household waste on or from properties with five (5) or more residential units, such as mobile home parks or multi-family dwellings
  12.          vi.        Household waste originating from another’s property.
  13.          vii.       Hazardous Materials
  14.          viii.      Materials containing asbestos.
  15.    E)    Any open burning shall be constantly attended until the fire is extinguished. At least one portable fire extinguisher with a minimum 4-A rating, two portable fire extinguishers with a minimum 2-A rating each, or other approved on-site fire extinguishing material/equipment, such as dirt, sand, water barrel, garden hose, or water truck, shall be available for immediate utilization.
  16.    F)    The location for any open burning shall not be less than fifty (50) feet from any structure, and provision shall be made to prevent the fire from spreading to within fifty (50) feet of any structure.
  17. Burn Permits may be issued for the following:
  18.    A)   Burning leaves, brush, and vegetation.
  19.          i.          Allowed within Ozark Fire Protection District (OFPD) boundaries and the city limits of Ozark (excluding the city limits of Fremont Hills).
  20.          ii.         Allowed during the following weather conditions:
  21.                      a.          Sustained wind speed below 10 mph
  22.                      b.          Relative humidity above 35%
  23.          iii.        Allowed between 10:00 am and 4:00 pm
  24.          iv.        The fire area size cannot exceed sixteen (16) square feet.
  25.    B)    Bonfires
  26.          i.          The bonfire shall not be more than five (5) feet tall by five (5) feet wide by five (5) feet long in dimension and shall not burn longer than three (3) hours.
  27.          ii.         Shall not be conducted within fifty (50) feet of a structure or combustible materials unless the fire is contained in a barbeque pit and provision shall be made to prevent the fire from spreading to within fifty (50) feet of any structure prior to ignition.
  28.          iii.        Fuel for the bonfire shall consist only of seasoned dry firewood and be ignited with a small quantity of paper.
  29.           iv.       The fire shall not be used for waste disposal purposes, and the fuel shall be chosen to minimize the generation of air contaminants.
  30.    C)    Recreational fires
  31.           i.         An outdoor fire burning materials other than rubbish where the fuel being burned is not contained in an incinerator, outdoor fireplace, portable outdoor fireplace, barbeque grill, or barbeque pit and has a total fuel area of 3 feet (914 mm) or less in diameter and 2 feet (610 mm) or less in height for pleasure, religious, ceremonial, cooking, warmth, or similar purposes.
  32.           ii.        Shall not be conducted within twenty-five (25) feet of a structure or combustible materials and provisions shall be made to prevent the fire from spreading to within twenty-five (25) feet of any structure.
  33.           iii.       The fire shall not be used for waste disposal purposes.
  34.           iv.       Fire exceeding the above dimensions will be classified as a bonfire.
  35.    D)   Burning vegetation at land clearing operations
  36.           i.         Requires a site visit from the Office of the Fire Marshal of the OFPD
  37.           ii.        Take place between Sunrise and Sunset
  38.           iii.       Be conducted two hundred (200) yards from the nearest structure not owned by the party conducting the burning, unless an Air Curtain Incinerator is being used and
  39.                      a.          Obtain waivers from the owner or occupant of the structure, or
  40.           iv.       OFPD provides approval when the distance cannot be maintained.
  41. The Burn Permit, if approved, is only valid for thirty (30) days.
  42. The Fire Marshal or his designee shall inspect all open burn sites required to obtain a permit through this district before ignition twenty-four (24) hours’ notice is required to schedule an inspection.
  43.    A)   Inspection hours are Monday through Friday (excluding holidays) between 8:00 am and 4:30 pm.
  44. The Fire District shall be notified on the day of the burn before the ignition of the fire.
  45. IF a permit is approved, the open burning shall comply with all the requirements addressed herein, and with any City, County, State, and Federal Rules and Regulations that may apply.
  46. Should the stipulations of this permit be violated or if a complaint, nuisance situation, or other hazardous, or potentially hazardous situation be created by this open burning, the Ozark Fire Protection District may revoke this permit.
