Vendor Contract and Agreement
Booth Application and Contract and Agreement of Liability Waiver

I have received and understand the Maxon Production and Events Rules and Regulations and the Requirements for all vendors. After I have been approved by the Maxon Production and Events staff, I understand that I will be an authorized vendor at the Maxon Production and Events small business expos and agree to abide by all the Rules and Regulations and the Requirements. I understand that I may be required to have a Food Permit if I am selling any food items. Should I wish to sell products not listed on this form, I will submit them for approval before an intended sell date.

Agreement of Liability Waiver

I hereby release, waive, discharge, covenant not to sue and agree to hold harmless for any and all purposes Maxon Production and Events, its officers, employees, successors, assigns, sponsors and volunteers from any and all liabilities, claims, demands, personal injury including death, or property damage that may be sustained by me while participating in the Maxon Production and Events expos or markets, including injuries or damages sustained as a result of the negligence of Maxon Production and Events

Vendor Rules and Regulations

1.The market and immediate vicinity is a "Family-friendly" area and all are expected to act appropriately.
2. Vendors are required to wear shoes and shirts at all times. Vendors should wear clean clothing and present a professional appearance.
3. Vendors may not smoke in any vendor area.
4. Foul language, profanity, or other rude behavior is not permitted.
5. Possession of firearms or consumption of alcohol or use of drugs, or operating hours under the influence is not permitted and is grounds for permanent eviction from the market.
6. Each vendor will be assigned at least a 10x10 space.
7. Booth spaces are reserved to all vendors at the Christmas Market in Old Town Burleson first come first serve basis.
8.A vendor forfeits their reserved space if any event is missed without notifying the MPE Coordinator.
9. All vendors must read and understand all the Rules and regulations, and adherence to related governmental rules and permit requirements.
10. Required applications, permits, licenses and fees must be complete before vendors will be allowed to participate in any event with Maxon Production and Events.
11. Vendors must provide their own table, chairs, signs, tents , refrigeration and generators (if needed). Weights on tents are mandatory!
12. Vendors providing samples of their products must comply with the rules governing sanitation and health issues from the city where the event is held or other authorities.
13. Manufactured food products must meet department requirements, including licensing and permitting rules.
14. All foods must be properly labeled. No unlabeled packaged or processed foods are allowed.
15. The vendor has solely responsible and liable for any claims and damages resulting from the sale of unsafe, unapproved or unsound items.
16. Vendors are responsible for obtaining a Sales Tax Number if required by the State of Texas and collecting and paying any sales tax that may be assessed on their products. The vendor shall be responsible for filling any and all returns required by the State of Texas with respect to sales tax collection. Maxon Production and Events will not involve itself in collection, audit or other related sales tax activities.
17. Trash must be placed in suitable containers. Boxes that are left at the event for disposal must be broken down and placed in the trash receptacles. No trash should be left in the event area.
18. Restrooms are available on site.
19. Fund-raising opportunities are also available for non-profit organizations. Items offered for sale will be by approval only.
20. It is the responsibility of the perspective vendor to complete, sign and return all required paperwork and fees. Incomplete packets will not be processed.
21. All vendor fees are non-refundable. If you’re unable to attend your booth, you may have someone else cover your booth during the event.
22. Maxon Production and Events are not responsible for vendor sales.
23. All photos taken by Maxon Production and Events can be used on their webpage and facebook page for advertisement and promotions.


Contract Agreement

I have read the Contract, Rules and Regulations and Requirements for Vendors regarding any event hosted by Maxon Production and Events. By paying the vendor fee, I agree to the conditions and terms of this contract. I understand once approved, payment must be received before setting up the day of the event. It is understood and agreed by applicant that this entire document constitutes a contract between the Vendor and Maxon Production and Events. Verbal agreements or promises made verbally and not specifically stated and confirmed in writing, as part of this Contract, will not be binding. I understand that smoking is not allowed at any Maxon Production and Events Expo or Market. I attest that the information provided is true and accurate. I agree to comply with Maxon Production and Events Rules and Regulations and Requirements for Vendors, as well as all applicable guidelines as specified by state and federal guidelines. I understand that failure to do so may result in revocation or suspension of the application.
