Mahalo for volunteering with Mālama Maui Nui ("M.M.N."), we are incredibly grateful for your support of our organization and our community! Before volunteering at an event, you MUST read, agree to, and sign the following volunteer waiver. If you have any questions after review, please contact a M.M.N staff member.
(1) Volunteer Agreement
In connection with your volunteer participation at a M.M.N. event, you expressly agree to all terms contained within this waiver.
(2) Volunteer Participation
You understand that you are serving as a non-compensated volunteer. Further, you agree that you are not an employee of M.M.N., and you are not entitled to any form of compensation, benefits, or reimbursement for your service as a volunteer. During the entirety of your time as a volunteer with M.M.N., you are solely responsible for your own medical, disability, hazard, and liability insurance coverage. If you elect to not carry any such insurance, you do so at your own risk.
(3) Assumption of Hazards and Risks
You understand that there is an inherent risk of personal injury associated with your voluntary participation in the activities related to serving as volunteer with M.M.N., including but not limited to illness, paralysis, permanent disability, damage to personal property, and death. You further agree and understand that M.M.N. has made no promises or assurances as to the conditions that might lead to aforementioned risks.
(4) Use of M.M.N. Materials & Equipment
During your participation in a M.M.N. event, you may have access to M.M.N. materials and equipment affiliated with the event. You understand that such materials and equipment are to be used solely for the activity directly related to the M.M.N. volunteering event. Further, you agree that prior to using M.M.N materials or equipment, you have been trained and/or understand the proper use and operation of such items. Finally, if you are not able to and/or do not feel comfortable using such materials or equipment, you shall not use them and will notify M.M.N. staff immediately.
(5) Confidentiality Agreement
During the course of your participation as a volunteer at a M.M.N. event, you may have access to materials, data, strategies, trade secrets, proprietary information, systems, or other information relating to M.M.N. that are intended for internal use only. You hereby agree that any such information acquired by you shall not be used, published, or shared without the express written consent of an authorized M.M.N. representative.
(6) Photograph and/or Video Recording Release
As volunteer at a M.M.N. event, you agree to and understand that photographs and/or video recordings may be taken and such materials may be used in M.M.N. promotional and marketing materials. You hereby waive any such right to approve, modify, or inspect such photographs and/or video recordings before such use by M.M.N.
(7) Indemnity Agreement
By volunteering with M.M.N and signing this waiver, you agree to indemnify and hold M.M.N. harmless from all liability as a result of your service as a volunteer at the M.M.N. event indicated below. This waiver of liability applies to any loss, damage, or injury, including death, that may be sustained by me during the course of my volunteer activities, whether caused by the negligence of M.M.N. or otherwise.
(8) Compliance with Applicable Laws, Rules, and Regulations
You agree that during your participation as a volunteer with M.M.N. you will comply with all applicable federal, state, or county government laws and any applicable rules, policies, or procedures of M.M.N.
