Dear Mayor Adams,
New York City’s Local Law 97 is the world’s most-important city-level climate and jobs law. It requires large buildings – the bulk of NYC’s real estate square footage – to slash their climate pollution. The on-site energy efficiency upgrades that the law induces will create tens of thousands of good-paying jobs and massive capital investment for decades to come, while the pollution reductions will lead to significant health benefits for all New Yorkers and climate benefits here at home, but also far behind the borders of our five boroughs.
Local Law 97 also stands to cement New York City as a national and global leader on climate action and in climate-tech. As founders, workers, and investors in climate tech, and/or as climate concerned New Yorkers, we stand in strong support of the full, timely implementation and enforcement of Local Law 97. We understand that an important rule-making with respect to this landmark law is imminent, and we feel compelled to raise our voices to call for clear, unequivocal leadership from City Hall on this issue. In particular:
1. No loopholes, including with respect to RECs, should be opened up that would weaken Local Law 97 or allow buildings subject to the law to cheaply buy their way out of compliance.
2. There should be no delays in the 2024 enforcement cycle, and no reduction in the mandated fines for buildings that fail to come into compliance.
It’s worth highlighting here that ~80% of buildings subject to Local Law 97 are already compliant with the 2024 requirements, and that for the vast majority of those that aren’t yet, the path to compliance is straightforward, affordable, and likely to save them money over time.
All the same, we understand that you are under intense pressure from well-organized special interests seeking to weaken or even gut this landmark piece of legislation. We understand that they would like you to loosen the law’s requirements and enforcement. We therefore call on you to stand strong in the name of urgent climate action, certainly, but also because climate-tech is the future. Retrofitting all of New York City’s buildings will make the city healthier, safer, and a more beautiful and humane place for all of us who live here, but it will also fuel booming industries for decades to come, and spawn world-leading businesses that will reshape the world over the course of this century.
We want to live in that version of New York that is remade to face, and be the face of the 21st century, and we want those world-leading businesses to continue to be built and headquartered here. Local Law 97 can be a key engine of just such a future for our great city, so even as you experience intense pressure to keep New York languishing in 20th century modalities, we call on you to choose the industries of the future and a better city for all.
