I, on behalf of myself, and/or my Minor Child, attest and verify that I am over 18 years of age and am legally signing on behalf of myself (collectively identified as spectator/coach/participant) and/or, if applicable, on behalf of my Minor Child (collectively identified herein as "Participant")
In consideration of requesting to and/or being allowed to participate/spectator/coach in any athletics/sport programs and/or otherwise participating in or attending events or activities at Incarnate Word University 4301 Broadway, San Antonio, TX 78209 coinciding with the date of receipt of this document and all future dates hereafter, the undersigned:
Agrees that prior to participating, he/she will inspect the facilities and equipment to be used, and if he/she believes or has reason to believe that anything is unsafe, will immediately advise a representative Collegiate Recruitment Consultants, LLC of such conditions and refuse to participate; Acknowledges and fully understands that each participant/coach/spectator will be engaging in activities that involve risk of serious injury, including permanent disability and death, and severe social and economic losses which might result from not only their own actions, but also the actions, inactions or the negligence of others, the rules of play, or the conditions of the premises or of any equipment used. Further, that there may be risks not known to us or not reasonably foreseeable at this time. Assumes all the foregoing risks, as well as all other risks, known and unknown, and accepts personal responsibility for the damages following such injury, permanent disability or death; To the fullest extent permitted by law, releases, waives, and forever discharges and covenants not to sue or assert any action or claim against Collegiate Recruitment Consultants, LLC 157 N Hillside Ave, Chatham, NJ 07928 and/or their affiliated clubs or entities, all of their respective members, administrators, directors, coaches and other employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners or lessees/lessors of the premises, all of which are collectively hereinafter referred to as the "Released Parties", from any and all "Released Claims". As used herein, the term "Released Claims" shall mean any and all actions, causes of action, suits, debts, dues, accounts, bonds, covenants, contracts, agreements, judgments, torts, indemnification and/or defense obligations and claims and demands whatsoever, in law or equity (whether or not heretofore known, suspected or asserted), including but not limited to any such actions, causes of action, suits, debts, dues, accounts, bonds, covenants, contracts, agreements, judgments, torts, indemnification and/or defense obligations and claims and demands arising out of, relating to or in any way connected with, caused, by, or alleged to be caused in whole or in part by the negligence of the Released Parties, or otherwise; Grants unlimited permission to Collegiate Recruitment Consultants, LLC to use, reproduce, sell, disseminate and distribute any and all photographs, images, videotapes, recordings, or any other depiction of any kind for any legitimate purpose in perpetuity, including but not limited to use on
Collegiate Recruitment Consultants, LLC website and/or in any advertising and/or promotional material and understands that he/she will not be entitled to any compensation in connection therewith; Shall defend, indemnify, and hold Collegiate Recruitment Consultants, LLC 157 N Hillside Ave, Chatham, NJ 07928
, all of their respective members, administrators, directors, offices, agents, and employees harmless from and against any and all liability, loss, expense, including reasonable attorney's fees, or claims from injury or damages arising out of the performance of this agreement but only in proportion to and to the extent such liability, loss, expense, attorney's fees, or claims for injury or damages are caused by or result from the negligence or the intentional acts or omissions of the individual or group renting space from the facility, its officers, agents or employees. The undersigned has read and acknowledges that he/she is entering into the above waiver, release, and image release consent understanding that he/she has given up substantial rights by signing it, and nonetheless hereby agrees to voluntarily sign. Without limiting the generality of the foregoing, it is my intention on behalf of myself or minor child to specifically release or indemnify Collegiate Recruitment Consultants, LLC 157 N Hillside Ave, Chatham, NJ 07928, and all of their respective members, administrators, directors, offices, agents, and employees, from any and all claims, including but not limited to claims arising from their own negligence. I agree to indemnify, defend and hold harmless Collegiate Recruitment Consultants, LLC 157 N Hillside Ave, Chatham, NJ 07928, and all of their respective members, administrators, directors, offices, agents, and employees from any liabilities, losses, damages, settlements, claims, expenses and costs arising from me or my child's participation in the desired activity, said indemnity to include court costs and reasonable attorney's fees.
