This Liability Waiver and Release Agreement ("Agreement") is made by and between the undersigned participant ("Participant") and Circle S: Second Chance Ranch LLC (the "Ranch") in connection with activities involving animals and livestock provided by the Ranch. These include, but are not limited to, equestrian-related activities such as horseback riding, trail rides, horse care, and training, as well as contact with, care for, observation of, or proximity to any other animals or livestock located on or associated with the Ranch (collectively referred to as "Animal Activities"). Livestock and animals may include but are not limited to: horses, ponies, donkeys, goats, pigs, sheep, chickens, ducks, rabbits, cows, and other domesticated or farm animals.

By signing below, the Participant agrees to the following:

Assumption of Risk

The Participant understands that Animal Activities involve inherent risks, dangers, and hazards, including but not limited to the risk of injury or death due to animal behavior, bites, kicks, scratches, allergic reactions, zoonotic diseases, falls, or other accidents. With respect to equestrian-related activities, the Participant acknowledges the protections and limitations outlined under New Jersey's "Equine Activity Liability Act" (N.J.S.A. 5:15-1 et seq.). The Participant further acknowledges that risks exist with all animals, regardless of their size, species, or temperament, and voluntarily assumes all such risks associated with participating in or being near any Animal Activities on the Ranch.

Release of Liability

In consideration for being allowed to participate in Animal Activities, the undersigned Participant, on behalf of themselves, their heirs, assigns, personal representatives, and next of kin, hereby fully and forever waives, releases, and discharges Second Chance Ranch, its owners, employees, agents, volunteers, contractors, affiliates, and representatives (collectively, the "Releasees") from any and all claims, demands, damages, actions, causes of action, or liabilities arising out of or in any way related to the Participant's involvement in any Animal Activities, including but not limited to claims for personal injury, property damage, death, or any other loss, whether caused by the negligence of the Releasees or otherwise, except as provided under applicable law.

Indemnification

The Participant agrees to indemnify, defend, and hold harmless the Releasees from any and all claims, demands, damages, actions, and liabilities, including reasonable attorneys' fees, arising out of or in connection with the Participant's involvement in Animal Activities, whether caused by the negligence of the Participant, the Releasees, or any third party.

Medical Treatment

The Participant consents to receiving any necessary medical treatment in the event of an injury, accident, or illness while participating in any Animal Activities. The Participant further agrees to assume all costs associated with such treatment.

Representation of Health

The Participant represents and warrants that they are in good physical health and capable of safely participating in Animal Activities. The Participant agrees to immediately inform the Ranch staff of any medical conditions or physical limitations that may affect their ability to safely participate in such activities.

Photography and Media Release

The Participant grants permission to the Ranch to take photographs, videos, or other media of the Participant during any Animal Activities, and agrees that such media may be used by the Ranch for promotional purposes, including social media, website content, and marketing materials, without compensation or further consent.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.

Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement shall continue in full force and effect.

Acknowledgment of Understanding

The Participant acknowledges that they have read this Agreement, fully understand its terms, and voluntarily agree to all of its provisions. The Participant affirms that they are signing this Agreement of their own free will and that they are not relying on any representations or promises made by the Ranch other than those stated in this Agreement.

By completing the below required boxes, I acknowledge I have read, understood, and agree to the terms of the aforementioned liability waiver.  If participant is under 18 years of age, I am the parent or legal guardian of the minor named below, and I hereby consent to the minor's participation in Animal Activities at Second Chance Ranch. I also agree to all terms and conditions of this Waiver and Release Agreement on behalf of the minor.
