HAMILTON COUNTY SPRING CLEAN-UP VOLUNTEER RELEASE

I, being an adult over the age of 18 years, do hereby release, hold harmless, and discharge Hamilton County Government, its officers, agents and employees from any and all risk and liability for injury to my person, damage to my property, or death, whether or not such liability is based upon allegations of negligence, or acts of omission, while participating in HAMILTON COUNTY SPRING CLEAN-UP and/or other volunteer activities on or near a state or county-owned right-of-way. I acknowledge the fact that working in the area of roads can be a hazardous activity, and I accept the risks associated with this work.

PARENT OR LEGAL GUARDIAN CONSENT RELEASE

This section is required if the volunteer is under 18 years of age

I certify that I am the parent or legal guardian of the minor volunteer named above, and hereby consent for this minor to participate as a volunteer in the HAMILTON COUNTY SPRING CLEAN-UP event Saturday, May 6th.

As to said minor, I further do hereby release, hold harmless, and discharge Hamilton County Government, its officers, agents and employees from any and all risk and liability for any injury to my and/or said minor’s person, damage to my and/or said minor’s property, or death, whether or not such liability is based upon allegations of negligence, or acts of omission, while participating in the HAMILTON COUNTY SPRING CLEAN-UP and/or other volunteer activities on or near a state or county-owned right-of-way.  I acknowledge the fact that working in the area of roads can be a hazardous activity, and I, on behalf of said minor, accept the risks associated with this work.

I certify that I have reviewed and fully understand this Hamilton County Volunteer Release.

Parent/Legal Guardian Signature:

In consideration of and as a condition to being allowed to participate in volunteer activities of Hamilton County’s “Spring Clean-Up”, I, for myself and for my heirs, executors, administrators, assigns and legal representatives, hereby release and discharge Hamilton County and its officers, directors, employees, sponsors, affiliates and agents (herein cololectively referred to as “Releasees”) from any and all claims, causes of action or liability for personal injury (including death) or property damage/loss (herein "claims"), whether caused by the negligent acts of any of the Releasees or otherwise, in any way relating to my past, present or future participation in Hamilton County’s volunteer activities or participation in other activities or programs offered by another Hamilton County trash pickup day, other than any claims caused by the gross negligence or willful misconduct of any of the Releasees.

If I am signing this Waiver as a parent or guardian on behalf of a minor, this Waiver is also legally binding as to any minor child(ren) for whom I am signing and the heirs, executors, administrators, assigns and legal representatives of such minor.

I hereby expressly waive any and all such claims, acknowledge the potential risks associated with participation in activities and programs offered by Hamilton County’s “Spring Clean-Up” and assume all risks of participation in any activity or program offered by Hamilton County Government.

I agree to indemnify and hold each of the Releasees harmless from any claims asserted, or that may be asserted, by me or by any of my family members or guests which in any way relate to the participation by me or any family member or guest in any activity or program offered by Hamilton County’s “Spring Clean-Up,” whether such claims arise from the negligence of any of the Releasees or otherwise, but excluding any claims arising from the gross negligence or willful misconduct of any of the Releasees.

I agree that if any provision of this Waiver is held to be unenforceable, then that provision will be construed either by modifying it to the minimum extent necessary to make it enforceable (if permitted by law) or by disregarding it (if not permitted by law). If an unenforceable provision is modified or disregarded in accordance with this section, the rest of the Waiver will remain in effect as written.

I HAVE READ THE FOREGOING WAIVER, RELEASE AND INDEMNITY AGREEMENT IN ITS ENTIRETY AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT BY SIGNING BELOW I MAY GIVE UP SUBSTANTIAL RIGHTS I WOULD OTHERWISE HAVE TO RECOVER DAMAGES FOR LOSSES.
