Every person MUST read, complete and acknowledge this waiver before attending the Sir Winston Churchill Park Tennis Club (the “Club”).

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person, but may also be transmitted by touching contaminated surfaces.

The Club has put in place preventative measures to reduce the spread of COVID-19; however, the Club cannot guarantee that you (or your children) will not become infected with COVID-19. Further, attending the Club could increase your risk (and your children’s risk) of contracting COVID-19.

I acknowledge the contagious nature of COVID-19 and I am aware that there is a risk I and/or my children may contract COVID-19 while attending the Club.

I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club employees, volunteers, officers, directors, and program participants and their families. I acknowledge that it is not possible for the Club to make using its facilities or participating in Club activities completely safe or without risk of contracting COVID-19.

I voluntarily agree to assume all of the risk that I and/or my children may be exposed to or infected with COVID-19 as a result of attending the Club and accept sole responsibility for any illness or injury to myself (or to my children) that may result, including, but not limited to, personal injury, disability, death, damage, loss, claim, liability, or expense, of any kind, that I (or my children) may experience or incur in connection with my (or my children’s) attendance at the Club or participation in any Club programs or activities (“Claims”).

On my behalf (and on behalf of my children), I hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents, representatives, officers, directors, and/or volunteers of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.

I accept these risks and agree to the terms of this agreement even if the Club, and/or its employees, agents, representatives, officers, directors, and/or volunteers, is found to be negligent or in breach of any duty of care or obligation to me, and regardless of whether a COVID-19 infection occurs before, during, or after participation in any Club program or activity.
