Applicant requests reservation of a vendor booth at:
Event on Event Dates from Load-In to Load-Out at Event Location.
There are a limited number of booths available at Event and booths will be allocated at the sole discretion of Producer.
Included in your vendor fee is the following:
Food Vendors: One 10'x10' tent + four tables + two chairs
Market Vendors: One 10'x10' tent + two tables + two chairs
Display Vendors: One 10'x10' tent + two tables + two chairs
A certified cheque, cash, PayPal or Interac payment payable to "MonstrARTity" is required along with application. Applicant agrees that their booking of a vendor space will be confirmed only after full payment is made to MonstrARTity. All payments are non-refundable regardless of weather (rain or shine) on Event Date(s) once application has been accepted.
Applicant agrees a $200 deposit must be made to Producer to secure their booth at Event. This deposit will be fully refunded immediately ON THE CONDITION THAT Applicant is off-site by 11:45 PM on the day of Load-out.
Applicants acknowledges that they must have a business license to sell at Event. Applicant confirms they are willing to immediately produce proof of their business license if requested.
Applicants requesting to reserve a booth as a Food Vendor agrees they must also separately complete the Region of Peel Public Health Special Event Application for Food Vendors (
https://www.peelregion.ca/health/environNew/forms/vendor-info-form.asp) to be considered for a space at Monster World Mashup.
Confirmation of completion of the Special Event Application for Food Vendors MUST be emailed to vendors@MonsterRockOrchestra.com or printed and faxed as per the number at the bottom of this form by FRIDAY, MAY 18, 2018.
Applicant acknowledges Producer reserves the right to remove any vendor from Event who fails to abide by any part of this agreement and Applicant hereby waives any right and all claims for damages or compensation by reason of Producer exercising this right.
If Event is delayed or prevented in whole or in part, for any reason, including, but not limited to, acts of God, fire, floods, storms, accident, illness, strike, lockout or other labour-management dispute, or any other cause beyond the control of the parties, neither party shall be subject to any liability, loss or damages of any kind.
Applicant understands that although Producer intends to exercise its best effort to market and advertise the event, the number of visitors to the event or at any booth/display is not guaranteed and Producer will not be held liable for any compensation whether monetary or otherwise for lack of attendance at the event.
Producer and Applicant will each look to its own insurance for recovery of any loss. Producer and Applicant release one another from such claims. Applicant waives any right of recovery of insured claims by anyone claiming through them, by way of subrogation or otherwise, including their respective insurers. This waiver remains effective despite Applicant’s failure to obtain insurance.
Applicant agrees to provide Producer a Certificate of Standard CGL Insurance naming "MonstrARTity Creative Community" as an Additional Insured with provision for 30 days notice of cancellation to the Insured.
Applicant shall, both during and following the Terms of this Agreement, save harmless and fully indemnify the Producer and its officials, officers, employees, agents, representatives, contractors, successors and assigns from and against any loss of, or damage to, property, personal injury or death, or any other losses, actions, claims, causes of action, damages, both direct or indirect, and such other costs and expenses, howsoever and whatsoever incurred, suffered or sustained by the Applicant, its employees, servants, agents, contractors, retained performers, invitees or affiliated participants, during Event.
This Agreement shall be effective only after confirmation from Producer and will expire and be fully terminated at 11:59 PM on the day of Load-out (the “Termination Date”).
