Your performance will be recorded and added to Warfield's data base for coaches, recruiters, and agents to use.

PLEASE READ CAREFULLY BEFORE SIGNING. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

Definitions

"Participant" means the individual registered to take part in the Event, whether an adult or a minor.

"Signer" means the person signing this Agreement: (a) the Participant, if the Participant is 18 years of age or older; or (b) the Participant's parent or legal guardian, if the Participant is under 18 years of age.

"the Activity" means the Event and all related athletic testing and evaluation, including agility drills, speed and change-of-direction testing, jumping and strength assessments, skills demonstrations, warm-ups, cool-downs, and any associated activities.

If the Participant is under 18, the Signer signs both on the Participant's behalf and on the Signer's own behalf, and every reference in this Agreement to the Signer's agreement, release, assumption of risk, or representation is made in both capacities.

In consideration of the Participant being permitted to participate in the Activity, the Signer agrees as follows:

1. Nature of the Activity

The Signer understands that the Activity consists of non-contact athletic testing and evaluation, and that this is the case for all divisions and age groups. The Activity does not include tackling, rucking, mauling, scrummaging, scrimmaging, contact drills, or any other form of contact rugby play.

2. Acknowledgment and Assumption of Risk

The Signer understands that the Activity involves strenuous physical exertion and carries inherent and other risks that can result in injury, illness, permanent disability, or death, as well as damage to or loss of property. These risks include, but are not limited to: sprinting, rapid acceleration and deceleration, rapid changes of direction, jumping and landing; falls and collisions with the ground, equipment, fixed objects, or other participants; being struck by equipment or other persons; overexertion, dehydration, heat illness, and cardiac events; sprains, strains, fractures, dislocations, and soft-tissue injuries; and head, neck, or spinal injuries, including concussion resulting from a fall or impact. The Signer further understands that risks arise from the conditions of the playing surface, facilities, and equipment, and from weather and heat conditions at an outdoor event held in July.

The Signer understands that these risks may be caused by the Participant's own actions or inactions, the actions or inactions of others, the condition of the premises or equipment, or the negligence of the Released Parties (defined below). The Signer knowingly and voluntarily assumes all such risks, both known and unknown, and accepts responsibility for any resulting harm.

3. Release and Waiver of Claims

To the fullest extent permitted by law, the Signer, on behalf of the Signer, the Participant, and their respective heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and agrees not to sue the Organizer, together with its owners, officers, directors, employees, volunteers, coaches, evaluators, medical and athletic-training personnel, contractors, sponsors, affiliated organizations, and the owners and lessors of the premises (collectively, "the Released Parties"), from any and all claims, demands, liabilities, damages, costs, or causes of action of any kind arising out of or related to the Participant's participation in the Activity, including any such claims alleging the negligence of any of the Released Parties.

4. Indemnification and Hold Harmless

The Signer agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) brought by or on behalf of the Participant, the Signer, or any third party, arising out of or related to the Participant's participation in the Activity or any breach of this Agreement.

5. Age and Division Eligibility

The Signer represents that the Participant satisfies the age and eligibility requirements for the division in which the Participant is registered, as published by the Organizer, and that the date of birth provided below is accurate. The Organizer reserves the right to require proof of age and to exclude any participant who does not meet the published eligibility requirements.

6. Representation of Fitness and Condition

The Signer represents that the Participant is in good physical health and condition, is physically capable of participating in the Activity, and has no medical condition that would make participation hazardous. The Signer is solely responsible for determining the Participant's fitness to participate and is encouraged to obtain a physical examination for the Participant prior to the Activity. The Signer has disclosed below any medical condition, allergy, medication, or prior injury relevant to the Participant's safe participation. The Participant will immediately cease participation and notify event staff upon experiencing any sign of injury, illness, or distress.

7. Concussion Awareness

The Signer acknowledges receiving and reviewing the concussion information provided by the Organizer. The Signer understands that any participant suspected of having sustained a concussion or head injury will be removed from the Activity immediately, and may not return to participation without clearance from a qualified health care professional.

8. Consent to Emergency Medical Treatment

In the event of injury or illness, the Signer consents to the Participant receiving first aid and emergency medical treatment, and authorizes the Released Parties to arrange for such treatment, including transport to a medical facility. Where the Participant is a minor, this authorization applies if the Signer cannot be reached promptly. The Signer understands and agrees that the Signer is responsible for all costs associated with any such treatment and transport.

9. Insurance

The Signer understands that the Released Parties do not provide health, accident, or disability insurance covering the Participant for the Activity, and that the Signer is responsible for maintaining any such insurance the Signer deems appropriate.

10. Media Release

The Signer grants the Organizer and its designees the irrevocable right to photograph, film, and record the Participant during the Activity, and to use, reproduce, and distribute such images, footage, recordings, and the Participant's name and likeness for promotional, evaluative, archival, and informational purposes, in any media now known or later developed, without compensation.

11. Rules and Conduct

The Signer agrees that the Participant will observe and obey all posted rules, safety instructions, and the directions of event staff, and will conduct himself or herself in a safe and sportsmanlike manner. The Organizer reserves the right to remove any participant from the Activity for conduct deemed unsafe or inappropriate, without refund.

12. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable. In particular, if the release in Section 3 is held unenforceable as to a minor Participant, it shall remain in full force and effect as to the Signer and all other claims.

13. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any dispute arising under this Agreement shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and the Signer consents to the personal jurisdiction of those courts.

14. Entire Agreement

This Agreement contains the entire agreement between the parties regarding its subject matter and supersedes any prior oral or written representations. No oral statement by any person modifies this Agreement.

15. Acknowledgment

The Signer acknowledges that the Signer has read this entire Agreement, fully understands its terms, understands that substantial rights are being given up, and signs it freely and voluntarily without any inducement. If the Participant is a minor, the Signer further acknowledges that the Signer is the parent or legal guardian of the Participant with full authority to sign on the Participant's behalf.
