Thank you for your interest in participating in (the “Event”) in support of SG United Foundation (“SG United”). Please acknowledge and agree to the following.

I understand,  acknowledge and agree to the following commitments (the “Commitments”):

I pledge to raise the “Fundraising Minimum”, which must be collected by me on or before the Event (“Due Date”), and in the event that I fail to satisfy the Fundraising Minimum by the Due Date, I will pay the shortfall amount and SG United is authorized to, without prior notice to me, charge any shortfall amount to my credit card;
In the event that I must withdraw from the Event for any reason (including due to injury or other life event), I understand that I am still responsible for satisfying the Fundraising Minimum and my entry and registration under SG United in the Event cannot be deferred to a later date;
My entry and my official race bib, race bib number and timing and scoring chip/device (“Bib”), and my right to obtain such Bib, is non-transferrable, non-assignable, non-refundable, and non-deferrable. I will not alter, modify or transfer my Bib in any manner to any person, organization or other entity for any purpose, including charity auction, lottery, or other fundraising efforts;
SG United does not assume any responsibility for my health, safety, security, or support in the Event, and any responsibility for medical costs of any kind associated with transport, care, and treatment related to the Event lies solely and absolutely with me;
If the Event is canceled, SG United has no obligation to me for any expenses that I may incur pertaining to my planned participation, whether for fundraising, travel, lodging, meals or any other matter;
All rules and guidelines of the Event and/or the Event organizers/officials must be abided by me, as a participant in the Event, and failure to abide by any rule or guideline may result in the immediate forfeiture and revocation of my entry and registration under SG United in the Event; and
I may be required by the Event and/or the Event organizers to execute, complete and deliver a registration form or additional documents, which is separate from any SG United team paperwork and/or any fundraising-related forms which may be required by SG United. Failure to execute, complete and deliver any such form or document may result in the immediate forfeiture and revocation of my entry and registration under SG United in the Event.

I, the undersigned, in consideration of my acceptance into the Event, hereby, for myself, my heirs, executors, and administrators, expressly and specifically assume the risk of injury or harm to me and expressly waive and release any and all rights and claims for liability and damages I or my heirs, executors, and administrators may have against SG United and its directors, officers, employees, members, agents, volunteers, representatives, successors and assigns (“Releasees”), for any and all injuries, illness or death suffered by me in or arising from the Event, and release and forever discharge SG United and the Releasees from any and all liability for injury, illness, death resulting from my participation in the Event. I acknowledge that it is my responsibility to understand the risks and determine whether I am fit to safely complete this Event and the precautions I should take. I attest and certify that I am physically fit and have sufficiently trained to complete this Event and understand the risks associated with participating in the Event. I attest and certify that I have no known conditions, impairments or maladies that would in any way endanger me or others during the Event. In addition, I voluntarily assume the risk of exposure to or infection by COVID-19 and/or other communicable diseases by participating in this Event. I acknowledge that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand the risk of becoming exposed to or infected by COVID-19 and/or other communicable diseases in connection with my participation in this Event and personally assume this risk.

I hereby irrevocably grant to SG United and its parent, subsidiaries, successors, licensees, agents, representatives, affiliates, and assignees (collectively, “Authorized Parties”) the royalty-free, irrevocable and perpetual right to record, photograph, visually identify, display, publish, reproduce, modify, edit or otherwise use, and permit others to use, my voice, performance, appearance, likeness, photograph, name, signature, gender, age category, charity affiliation, race times, occupation, town of residence and biographical information (collectively, my “Appearance”) in any medium or format, including film, video, broadcast, telecast, advertising and promotional materials, audio tape and still photography (collectively, the “Recordings”) in connection with the Event. I also grant to SG United the nonexclusive, perpetual, worldwide right, without further consideration, to use, copy, publish, reuse, or display any quote, personal statement or other testimonial and survey data (“Statement”) given by me during or in connection with the Event or the Recordings, whether given orally or in writing, in whole or in part, without restrictions, for any purpose, whether commercial (including, without limitation, advertising, publicity, promotion or marketing) or noncommercial, in any media. I agree that SG United shall own, and I hereby irrevocably transfer, assign, and convey to SG United, all right, title and interest to the Recordings, including copyrights, and shall have the worldwide, royalty-free, perpetual right to exhibit, distribute, transmit and/or otherwise exploit my Appearance and/or the Recordings, edited or altered, in whole or in part, as they may see fit, in all media, now known or hereafter developed, for any purpose, whether commercial (including, without limitation, advertising, publicity, promotion or marketing) or noncommercial. I further agree that my name, mailing address, email address, and dollar amount donated (or fundraised) may be shared by the Authorized Parties to the Event organizers. The rights granted by me hereunder are granted in perpetuity and no compensation or further consideration will be payable to me at any time in connection therewith. I will have no right of consultation or approval in connection with the rights granted hereunder. Nothing herein will constitute any obligation of the Authorized Parties to make any use of the rights set forth herein. I hereby expressly and specifically release and forever discharge SG United and the Releasees from any and all liability for property damage resulting from my participation in the Event, or use of my Appearance, Statement or Recording, including without limitation, any claims based on invasion of privacy, defamation, right of publicity or any other personal or property rights. I agree, for myself, to hold harmless, defend and indemnify the Releasees for and from any and all claims, demands, causes of action, lawsuits, damages, injuries, expenses (including attorneys’ fees) and other liabilities of any kind arising from or in connection with the Event, or the use of my Appearance, Statements or Recording.
