Thank you for your interest in the Columbia Falls Market. Please read the information below & ensure you have all the required documents, permits, and registrations before beginning your application. The Columbia Falls Community Market works with the Health Department and the City of Columbia Falls to make sure the safety of the community we serve is the first priority. Market Information
1. MARKET SEASON: Every Thursday-rain or shine-starting May 16, 2024-September 26, 2024

2. MARKET SELLING TIMES: 5:00 PM - 8:00 PM

3. MARKET SET UP TIMES:
a. Food Vendors 2:00-3:00 PM 
b. Craft Vendors 3:10-4:00PM

4. MARKET COSTS:  $5 plus 5% of gross sale each market. Vendors selected for the whole season, will pay the $5 per market ($100 total) in May to secure their spot for the season, then pay 5% on market days. Farmers will pay only $25 per market. 

5. MARKET SUBSTITUTES: Substitutes selected by Vendor Committee, pay $5 plus 5% gross sales to the Market. 

6. MARKET PRODUCTS: Must be at least 50% locally grown, handmade or locally embellished
a. Vendors permitted to sell only items in their application, additional products must be approved.

7. VENDOR PROVIDES: All display materials. If you choose to use a 10 x 10 canopy, weights are required (recommended 30lbs per leg)
a. All vendors must be self sufficient regarding power-there is no power provided at venue
b. Generators must be considered quiet by market staff

8. FOOD VENDORS & GROWERS:
a. You are responsible for meeting applicable health department codes, including City, County, State, & National Permits/Licenses. If you are uncertain, please call Flathead County Health Department at (406)751-8101.
b. Food Vendors MUST have approval from the Flathead County Health Department & provide a copy of their permit at the vendor meeting in May
c. All food vendors must provide a certificate of liability from your insurance company with the following business added as additional insured to the market staff before the beginning of the market season.

d. Food Vendors are responsible for providing 1 large trash receptacle at their booth & disposing of trash in bins at the end of the night.

9. MARKET ABSENCES: Notify Market Master or Treasurer of known absences by Monday before 6:00PM. All vendors who provide notice after 6:00 PM on Monday, are subject to a $25 fee. Spaces will be reassigned if you are a no-show / no call.

10. SAFETY/RULES AND REGULATIONS: Vendor shall take all reasonable precautions for the safety of its employees, workers, volunteers and all customers and visitors shopping in the market area and around its booth. Vendors shall comply with all applicable laws, ordinances, rules, regulations and lawful orders of the CFCMI Market staff OR any City of Columbia Falls Montana Official bearing on the safety or protection of persons or property located on or near the market area and in or around the booth.

11. No inappropriate behavior will be tolerated during the Market-be kind & lead by example!

12. SPECIAL ACCOMMODATIONS: Unfortunately, we are unable to provide any special accommodations to any vendor. Please review the above rules and make sure your schedule allows you to participate in this market. 

13. Return signed acknowledgment of rules & Hold Harmless Agreement for application processing.

Applications submission does not promise a space at the Columbia Falls Community Market. Approved applicants will be contacted on/by March 1st. Due to the success of the Market, we have limited availability, Columbia Falls Community Market reserves the right to accept or decline each vendor’s participation in the Market at anytime.

All vendors, including returning vendors, must submit this application form, all required documents and photos via online form or email to cfcommunitymarket@gmail.com. Applications received after March 31, 2024 will be subjected to a $25 processing fee which does not include approval.

Hold Harmless Agreement
Vendor shall comply & cause its employees & assistants to comply with any reasonable rules & regulations established by the CFCMI, including but not limited to, the Market Rules & Regulations.
• Vendor hereby acknowledges receipt of a copy of the Rules. CFCMI may change or alter the Rules as it deems necessary or appropriate for the overall good of the Market Area.
• Indemnification. Vendor shall defend, indemnify & hold CFCMI any parents, affiliates, principals, agents & employees of either & both, & any other CFCMIs, harmless against any & all claims whatsoever arriving in any way out of Vendor's acts or omissions in, on & about the Market Area & the activities therein.
• Assignment. CFCMI may reassign space in the Market Area as it deems necessary & in its sole discretion, provided that Vendor is given a space of equal area for which Vendor paid for in advance. Vendor may not assign this lease or allow others to use the booth space without prior written consent from CFCMI.
• Termination. This Agreement shall automatically terminate if Vendor does not timely pay Rent or fails to fully comply with any of the terms of this Agreement. In addition, CFCMI shall have the right to terminate this Agreement upon seven (7) days written notice to Vendor if CFCMI receives three (3) or more complaints about a Vendor's product, performance or conduct during the Term.
• Vendor's Exclusive Remedy. Vendor acknowledges & agrees that its sole & exclusive remedy under this Agreement against CFCMI for any reason shall be to require CFCMI to refund rental charges not earned by the CFCMI. Vendor waives any & all other rights or remedies which might be available in equity or in law, including the right to seek damages whether special, incidental, consequential or otherwise.
• Attorney's Fees. If any party hereto shall bring any suit or other action against another for relief, declaratory or otherwise, arising out of this Agreement, the losing party shall pay the prevailing party's reasonable costs & expenses, including reasonable attorneys' fees & court costs. The parties have caused this Agreement to be executed by their duly authorized representatives on the date first above set forth. By signing below, I certify that I have read, understand & agree to abide by the regulations of the Columbia Falls Market Inc. (CFCMI) specifically the regulations for this market year, as well as all laws, codes, & regulations that apply to doing business at CFCMI. I agree to hold harmless CFCMI & all of their officers, employees, representatives, directors or agent from & against all liability claims, suits, damages, levies, cost, losses & fees including attorney fee arising out of or related to my activities with CFCMI. I understand that false or misleading information in my application may lead to disqualification from CFCMI.
