The duties of California's local mental/behavioral health boards/commissions

For purposes of this document, "MHB" refers to local mental/behavioral health boards/commissions.

Training focuses on the DUTIES of the local mental health/behavioral health boards (per CA Welfare & Institution Code 5604.2).

Duty #1 - Review and evaluate the community's mental health needs, services, facilities, and special problems.

Duty #2 - Review any county agreements entered into pursuant to Section 5650.
Section 5650 refers to a detailed county/state agreement, the "Performance Contract". Within this document, there are assurances of MHB involvement with Mental Health Services Act (MHSA) plans and updates to include:

PUBLIC HEARINGS:
The MHB "shall conduct public hearings on the County's draft three-year program and expenditure plan and annual updates at the close of a 30 calendar day comment period."

REVIEW:
"The County's MHB shall review the adopted three-year program and expenditure plan and annual updates and make recommendations to County's mental health department for amendments." (WIC 5848(b) and Title 9, CCR, 3315)
As just mentioned, MHBs are to review the "adopted" three year program and expenditure plan. In practice, many MHBs review draft plans. However, reviewing "adopted" plans is the stated duty.
In order to review these large documents (that incorporate funding and programs for dozens of contractors), MHBs should identify ways to manage this task (see "FAQs #5" document for suggestions: https://www.calbhbc.com/faqs.html )

The CA Behavioral Health Planning Council provides questionnaires for MHBs to complete called "Data Notebooks". MHB's are asked to have their members comment on data that is provided within the questionnaire. The MHB should take the lead in completing the questionnaire with assistance from staff.

Duty #8. Nothing in this part shall be construed to limit the ability of the governing body to transfer additional duties or authority to a mental health board....
Many boards/commissions also advise regarding alcohol & drugs. In some counties, the board/commission is tasked with "Public Guardian" duties.
Realignment of Services - It is the intent of the Legislature that, as part of its duties pursuant to subdivision (a), the board shall assess the impact of the realignment of services from the state to the county, on services delivered to clients and on the local community. (5604.2(b))
