1. I wish to participate in Haunted Calgary Productions Inc. ("Haunted Calgary") activities and events. I understand that my execution of this Waiver and Release is a prerequisite for participation. I further understand that the inherent risk of injury from such activities is significant, including the potential for permanent paralysis and death. Particular rules, equipment, and personal discipline may reduce this risk.
2. I understand that in order to be allowed to participate, I agree to assume all risks and to release and hold harmless Haunted Calgary, and their officers, agents, employees, assigns, successors in interest, contractors, vendors (and their agents), agencies, sponsors, officials and volunteers, other participants, owners and lessors of the facilities and premises used to conduct such activities and events.
3. I intend by this waiver to release, in advance, and to waive my rights and discharge all the persons and entities mentioned above, from any and all claims for damages for death, personal injury, property damage, expense and related loss, including loss of income which I may, or my next of kin may, suffer as a result of my participation in this activity, or which may hereafter accrue to me as a result of my participation in Haunted Calgary, even though this liability may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective property or equipment owned, maintained, borrowed, or controlled by them or because of their possible liability without fault. I understand and agree that this waiver and release is binding on my heirs, assigns, and legal representatives and I agree to waive any and all such claims that I have or may in the future have against Haunted Calgary, its successors and assigns.
4. I understand that I am solely responsible for my health and safety, including safeguarding that of other participants, and acknowledge that I am physically capable of participating in these activities and events.
5. I agree to allow Haunted Calgary to use my photo, video, and likeness for any purpose related to advertising or promotion of Haunted Calgary in perpetuity in all forms of media now and forever known.
6. I also hereby acknowledge and agree to abide by the rules of the activity and policies of Haunted Calgary. In doing so, I acknowledge and agree that at no time will unsportsmanlike conduct, physical abuse, verbal abuse, disrespect to officials or other participants, over-aggressive play, and/or arguing with Haunted Calgary staff or volunteers be tolerated and that if I do not comply with the rules and policies that I may be suspended and/or expelled from the activity without a refund. Haunted Calgary also reserves the right to exclude intoxicated or disorderly participants from any, and all, portions of any activity or event without a refund.
7. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.
8. I have carefully read this Waiver and Release and fully understand its contents. I am aware that this is a release of liability and sign it freely and voluntarily without any inducement.
