Volunteer Agreement, Release, and Waiver of Liability

The Floyd Center for the Arts (FCA) is a nonprofit organization located at 220 Parkway Lane S, Floyd, VA. FCA facilities are used for exhibitions, concerts, educational programs, art production, meetings, and community activities.

In consideration of being permitted to enter FCA facilities, assist as a volunteer, or participate in any FCA-related activity (collectively, “Activities”), whether on-site or off-site, I agree to the following:

1. Liability Release

THIS IS A RELEASE OF LIABILITY.

I knowingly and voluntarily waive, release, and discharge, on behalf of myself and my heirs, legal representatives, successors, and assigns, the Floyd Center for the Arts and all affiliated entities, along with their directors, officers, board members, employees, agents, representatives, and volunteers (collectively, the “Released Parties”), from any and all liability.

This includes, but is not limited to, any claims, losses, injuries, damages, costs, or expenses (including attorneys’ fees), whether known or unknown, arising out of or related to my participation in any FCA Activities—including those caused by the negligence of FCA or the Released Parties.

2. Indemnification
I agree to indemnify and hold harmless FCA and the Released Parties from any claims, demands, or legal actions brought by third parties arising out of or related to my participation in FCA Activities, whether caused by negligence or otherwise.
3. Assumption of Risk

I understand that participation in volunteer and program activities involves inherent risks, which may include physical injury, illness, or other harm.

I voluntarily assume all risks associated with my participation and agree to take reasonable precautions to protect myself and others.

4. Emergency Medical Authorization

In the event of illness or injury during my participation, I authorize FCA to arrange for emergency medical care, including transportation, diagnosis, treatment, surgery, or medication as deemed necessary.

I understand and agree that I am solely responsible for any and all medical costs incurred.

5. Media Release

I grant FCA permission to photograph, film, or record me during Activities without compensation.

I further grant FCA the right to use, reproduce, publish, and distribute my likeness, voice, or image in any media, worldwide, for promotional, educational, or marketing purposes. This includes the right to edit, modify, or combine such media with other content.

6. Acknowledgment and Agreement

By signing below, I acknowledge that:
