I hereby release and hold harmless Brilliant Detroit and its affiliates, its officers, directors and employees (together referred to herein as Brilliant Detroit), from all claims for injury and damage of any kind resulting from my participation in Brilliant Detroit, including all related travel. On behalf of my minor child or children listed in the form above, I hereby release and hold harmless Brilliant Detroit and its affiliates, its officers, directors and employees (together referred to herein as Brilliant Detroit), from all claims for injury and damage of any kind resulting from my minor child or children’s participation in Brilliant Detroit, including all related travel.

I understand that this Release discharges Brilliant Detroit to the fullest extent allowed by law from any liability or claim that may be made against Brilliant Detroit whether caused by Brilliant Detroit or its officers, directors, employees, agents or otherwise. I understand that there are unavoidable risks attendant to the types of activities in which Brilliant Detroit engages and the project sites at which those activities take place. I hereby expressly and specifically assume the risk of injury or harm in these activities and release Brilliant Detroit from all liability for injury and damage resulting from my participation, and the participation of my minor child or children listed in the form above, in such activities.

To the fullest extent under the laws and regulations having jurisdiction over the subject matter of this waiver and release, each party shall indemnify, defend and hold harmless the other party (including such other party’s affiliates, partners, officers, directors, employees, agents, and representatives) against any claims, losses, damages, or liabilities of any nature, including reasonable attorneys fees, arising out of or relating to any breach of this Agreement by such party or any negligence of such party in connection with its participation in Brilliant Detroit.

I fully release and forever discharge Brilliant Detroit and its representatives and agents from any claim whatsoever which arises or may hereafter arise on account of any first aid or health treatment rendered or authorized in connection with my activities and/or participation with Brilliant Detroit. On behalf of my minor child or children listed in the form above, I fully release and forever discharge Brilliant Detroit and its representatives and agents from any claim whatsoever which arises or may hereafter arise on account of any first aid or health treatment rendered or authorized in connection with my minor child or children’s activities and/or participation with Brilliant Detroit.


Arbitration

In the event that a claim was to be pursued, I expressly waive rights to trial by jury under state and federal law and agree to submit any matter to binding arbitration. At arbitration, I would choose an arbitrator, Brilliant Detroit would choose an arbitrator, and the two arbitrators would select a neutral third arbitrator to decide any and all claims, actions, or disputes that could arise out of my participation with Brilliant Detroit.

I hereby authorize Brilliant Detroit and its affiliates to publish photographs and audio recordings taken of me, and my name, and likeness, for use in Brilliant Detroit’s print, online and video and digital-based marketing materials, as well as any other publications.  I further authorize Brilliant Detroit and its affiliates to publish photographs and audio recordings taken of my minor child or children listed in the form above, their name, and likeness, for use in Brilliant Detroit’s print, online and video and digital-based marketing materials, as well as any other publications.
I hereby release and hold harmless Brilliant Detroit and its affiliates from any reasonable expectation of privacy or confidentiality for myself and/or any minor child and/or children listed in the form above associated with the images specified above.  

I further acknowledge that participation is voluntary and that neither I and/or the minor child or children will receive financial compensation of any type associated with the taking or publication of these photographs, audio recordings, or participation in Brilliant Detroit marketing materials or other publications.  
I acknowledge and agree that publication of said photos and/or audio recordings confers no rights of ownership or royalties whatsoever.  I hereby release Brilliant Detroit, its contractors, its employees, and any third parties involved in the creation or publication of marketing materials, from liability for any claims by me or any third party in connection with my participation and/or the minor children listed in the form above.  

This document is a liability waiver and photo and video release form. In order to participate in BD programming, you must sign a liability waiver. We would also love your permission to share photo and video of you engaging in BD programming to encourage more people to join us in promoting Kid Success!

We invite you to participate in an evaluation of Brilliant Detroit’s programs. Your participation helps us understand if our programs are working and if they help to meet your needs and your community’s needs.

Introduction to Brilliant Detroit’s work

Brilliant Detroit helps children and families in your community have safe places to play and access to education and health. Each Brilliant Detroit site is neighborhood-based and designed jointly by families and service providers, aligning with existing programs in each neighborhood. Brilliant Detroit has two parts:

* It provides tools and activities to achieve school readiness, health, and stability for children and families; and

* It provides a set of common goals for child and neighborhood success.

The purpose of the evaluation is to learn about how the participation of families like yours in Brilliant Detroit helps you, your children, and your community.

Your participation in the Evaluation

As a Brilliant Detroit participant, you may be asked to:

* Fill out survey forms that ask questions about you and your family.

* Participate in interviews, focus groups or other online surveys about your experience with Brilliant Detroit programs.

* Answer questions or complete assessments about the school readiness or development of your youngest child. We are trying to understand whether Brilliant Detroit programs are helping young children.

The responses you give as part of the evaluation are kept strictly confidential. We do not share your personal information or individual responses in any way. The data is aggregated with that of other participants to help us understand how participation in Brilliant Detroit helps families and communities.
