Release of Liability & Assumption of Risk
*In consideration of being permitted to participate in a tour of Millennium Recycling, Inc. ("MRI"), the undersigned releases, waives, discharges, and covenants not to sue MRI, its agents, managers, directors, officers, and employees (collectively, the "Releasees") from any and all liability to the undersigned and the undersigned's parents or legal guardians for any loss, damage, injury, or death arising out of participation in the facility tour, whether caused by the negligence of the Releasees or otherwise, due to the undersigned being in or upon the MRI premises.
The undersigned further acknowledges and understands that MRI is an active industrial recycling facility containing moving equipment, conveyors, forklifts, balers, glass, metal, sharp objects, dust, uneven walking surfaces, and other hazards that may result in injury or damage to personal property. The undersigned understands these risks, appreciates their nature, and knowingly and voluntarily assumes all risks associated with participating in the facility tour.
The undersigned agrees to remain with the tour guide at all times, stay within designated tour areas, follow all safety instructions provided by Millennium staff, and not touch equipment, barriers, or materials unless instructed to do so.
The undersigned agrees to indemnify and hold the Releasees harmless from any loss, liability, damage, or cost, including reasonable attorney's fees, they may incur due to the presence of the undersigned in or upon the MRI premises, whether caused by the negligence of the Releasees or otherwise.
The undersigned understands that photographs and video may be taken during the tour and may be used by Millennium Recycling, Inc. for educational, promotional, or other lawful purposes. Individuals who do not wish to appear in photographs or video should notify Millennium staff prior to the start of the tour.
The undersigned further agrees that this Release of Liability and Indemnification Agreement is intended to be as broad and inclusive as permitted by the laws of the State of South Dakota. If any portion is determined to be invalid, the remaining provisions shall remain in full force and effect.
Millennium Recycling reserves the right to remove any participant who fails to follow safety instructions or whose behavior creates a safety risk for themselves or others.
The undersigned assumes full responsibility for all risks of injury or property damage while participating in the facility tour and agrees to comply with Millennium Recycling's dress code, including wearing long pants and fully enclosed footwear with closed toes, closed heels, and solid slip-resistant soles. Participants who do not meet these requirements will not be permitted to participate in the tour.
