In these extreme times of colonial fascism, racism, xenophobia, corruption, anti-lgbtq, anti-immigrant, anti-muslim, ableist, and anti-refugee policies, along with the exploitation with impunity of community members and workers, we commend and stand with all of those brave compañerxs who have been and continue to fight and call out whatever institution/agency or whomever may be perpetuating these attacks and injustices on all of our communities under this fascist regime.

Just as we fight against the separation of families by ICE and many other attacks on many communities throughout the U.S., it is also very important that we call out and stand up to injustices in our own community, no matter who is committing these injustices.  

Calling out injustices doesn't just mean calling out fascist politicians, their racist policies, or corporate exploitation. It also means calling out exploitation, harassment, and hostility by local union bosses in our own communities. Here in San Diego, the labor community is facing a very serious crisis: the lack of accountability to the community from some its own union bosses. This is a very sad state of affairs, as we see an upsurge of peoples’ movements rising up and fighting back. As we gear up to celebrate International Workers Day (May 1st), and the contributions that workers and unions have made here in the U.S., and around the world, we call on the San Diego May 1st Coalition and other compañerxs in struggle to analyze what it means to allow union bosses and their union representatives who exploit, harass, and intimidate other workers, to be at the table and make decisions in the organizing efforts leading up to International Workers Day events. It is a serious contradiction to allow exploitative union bosses and their union representatives to join us at the table to help plan and make decisions about International Worker’s Day actions.

On one hand we have the San Diego Office Coordinator, Genoveva Aguilar, at SEIU-USWW (Service Employees International Union-United Service Workers West), who has created a documented hostile work environment for her own staff, and has arbitrarily terminated 5 of her staff in 3 years. These 5 compañerxs, despite the injustices and exploitation that they have endured, have proven themselves effective and genuine organizers fighting alongside various communities throughout San Diego County.

The turnover and termination of several staff in recent years has left a visible impact on the membership. At public union actions, we have witnessed janitors visibly expressing their discontent with the SEIU-USWW San Diego management.  This is an embarrassing situation especially when janitors were supposed to be celebrating 20 years of struggle and union solidarity.

These concerns have the effect of antagonizing organizers and members, which restrains the ability to build the collective power of workers. Having a union boss who professes to fight for the respect of workers rights, but neglects those same values in the treatment of her own workers and members, destroys the fighting spirit we celebrate on International Workers Day, and alienates those workers and members who have felt exploitation, harassment, and intimidation, first hand.

As an example, the following are two testimonies from a long-time janitor and a former SEIU-USWW volunteer and ally to the janitors:

"Genoveva Aguilar, does not have good leadership qualities, she doesn't know how to resolve problems and fires whomever she sees as a threat to her, or who does not agree with what she does. SEIU-USWW San Diego has had a terrible contract for us janitors and everyday we lose co-workers. She imposes decisions onto the executive board and doesn't carry out elections as they should be carried out. She does not inform janitors of their rights.”

“For almost three years I have been denouncing publicly the abuses by Genoveva Aguilar within SEIU-USWW against the unionized workers who she supposedly represents. There are a number of complaints against her and Marilyn Armenta. From verbal abuse to despotism, lack of representation and professional follow up on the cases of workers, to subtle threats so that one does not denounce her abuse of authority. In addition to arbitrary dismissals of other organizers within the union and the favoritism with which she leads the union. There are legitimate complaints by workers who because of fear of losing their jobs and in cases for being undocumented decide to be silent and sustain the abuses. We cannot allow this to happen, we have an obligation to social justice.”

On the other hand, there is the very powerful union boss, Mickey Kasparian, President of United Food and Commercial Workers (UFCW) Local 135, and President of the San Diego-Imperial Counties Labor Council, who is the recipient of three lawsuits from former and current staff. The lawsuits range from sexual harassment, discrimination against womyn, hostile work environment, and retaliation.

We stand with the three brave compañeras, Sandy Naranjo, Isabel Vazquez, and Anabel Arauz for having the courage to fight against the injustices in their workplaces. Two faced union bosses who profess to fight for workers rights and instead exploit workers are no different from local politicians who profess to be about the community yet fill their pockets from private prison money.

May 1st is much more than just about celebrating the contributions and courage that workers worldwide have made to better the lives of millions of people. We can celebrate the contributions of workers without having to accept union and community partners who exploit their own personnel and disrespect their own membership. We need community accountability for the union members of both SEIU-USWW SD and UFCW Local 135, and any other union or community organization that creates a hostile environment for its own workers and members. There is too much work ahead of us to have unity just for the sake of unity. Our fight for justice has to encompass justice in our own communities, as much as it encompasses nationwide and international struggles for justice.

Let us fight capitalism in which ever head the hydra decides to show itself.

A lxs compañerxs de la coalición del Día de Los y Las Trabajadorxs en San Diego y en otras luchas justas:

En estos tiempos extremos de colonialismo fascista, racista, xenófobo, corrupto, anti-lgbtq, anti-migrante, anti-musulmán, capacitismo, y anti-políticas-para-refugiados, junto con la explotación impune de lxs miembros y trabajadores de la comunidad, reconocemos y nos solidarizamos con todxs lxs compañeros valientes que han estado luchando y que aún siguen luchando contra las instituciones/agencias o cualquier entidad que sigue perpetuando la injusticia hacia nuestras comunidades.

Así como luchamos en contra de la separación de familias por ICE y otros ataques hacia muchas comunidades en estos Estados Jodidos, es muy importante que también hagamos el llamado y luchemos contra las injusticias en nuestra propia comunidad, no importe quien sea que esté cometiendo tal injusticia.

Luchando contra la injusticia no quiere decir que solamente debemos denunciar a los políticos fascistas y sus políticas racistas o la explotación corporativa. También significa que tenemos la responsabilidad de denunciar la explotación, el maltrato, y hostilidad de los líderes de los sindicatos locales en nuestras comunidades. Aquí en San Diego la comunidad laboral está enfrentando una crisis: la falta de responsabilidad ante la comunidad de parte de algunos de los líderes sindicales. Esto es un hecho triste y ya hemos visto un alzamiento de lucha de parte de lxs trabajadorxs en contra de esos mismos líderes sindicales.

Mientras nos preparamos para celebrar el Día Internacional de los Trabajadorxs y las contribuciones que lxs trabajadores y los sindicatos han hecho en los Estados Unidos y en todo el mundo, hacemos un llamado a la coalición del 1ro de Mayo en San Diego y otrxs compas en la lucha para que analicemos las implicaciones de dejar que líderes corruptos de los sindicatos y sus representantes quienes explotan, abusan, e intimidan a otros trabajadores, se sienten en la mesa y tomen decisiones sobre los esfuerzos organizativos del Día Internacional de lxs Trabajdorxs. Es un contradicción muy seria dejar que estos líderes corruptos y sus representantes se unan a la mesa para organizar este evento junto con nosotrxs.

Por un lado tenemos a Genoveva Aguilar, la Coordinadora de la Oficina de San Diego de SEIU-USWW, que ha creado un ambiente de trabajo hostil para su propio personal y que ha despedido arbitrariamente a 5 de sus trabajadores en 3 años. A pesar de las injusticias y la explotación que han soportado, estxs 5 compañerxs han demostrado ser organizadorxs efectivxs y sincerxs y siguen luchando junto a varias comunidades en el condado de San Diego.

La terminación de varios trabajadorxs en los últimos años ha dejado un impacto visible en la membresía del sindicato. En acciones públicas del sindicato, hemos sido testigxs de cómo lxs trabajadorxs han expresado visiblemente su descontento con el liderazgo de SEIU-USWW San Diego. Esta fue una situación vergonzosa, especialmente cuando lxs conserjes justamente se encontraban celebrando 20 años de lucha y solidaridad sindical.

Estas preocupaciones tienen el efecto de antagonizar a lxs organizadorxs y miembrxs del sindicato, lo que perjudica la capacidad de construir el poder colectivo de lxs trabajadorxs. Tener un jefe sindical que profesa luchar por el respeto de los derechos de lxs trabajadorxs, pero que descuida esos mismos valores en el trato de sus propios trabajadorxs y miembrxs, destruye el espíritu de lucha que celebramos en el Día Internacional de los Trabajadores y enajena a los trabajadores que han sido víctimas de la explotación, hostigamiento, e intimidación, de primera mano.

Como ejemplo, los siguientes son dos testimonios – uno de unx trabajadorx veterano y otro de una persona que trabajó con SEIU-USWW como voluntaria y aliada de lxs trabajadorxs.

"Genoveva Aguilar, no tiene un buen liderazgo, no sabe resolver problemas y despide a quien cree es competencia para ella, o no está de acuerdo en lo que ella hace. El sindicato SEIU USWW San Diego ha tenido un pésimo contrato para los Janitors y todos los días se pierden trabajadores . Impone a la mesa ejecutiva pues no se hacen las votaciones como deben de ser. No informa a los janitors de sus derechos. "

“Desde hace tres años vengo denunciando públicamente los abusos cometidos por Genoveva Aguilar dentro del Sindicato SEIU y contra los trabajadores sindicalizados a quienes supuestamente representa. Existen innumerables quejas contra ella y Marilyn Armenta, desde maltrato verbal y despotismo, falta de representación y seguimiento profesional en sus casos, hasta amenazas sutiles para no denunciar el abuso de autoridad de parte de ella. Además de despidos arbitrarios de otros organizadores dentro del sindicato, y el nepotismo con que maneja al gremio. Quejas legítimas de los trabajadores, quienes por miedo a perder sus trabajos y en muchos de los casos, por no tener documentos, prefieren guardar silencio y soportar los abusos. Esto no lo podemos permitir, tenemos un compromiso con la justicia social.”

Por otro lado, está el muy poderoso jefe sindical, Mickey Kasparian, Presidente de la Sección Local 135 de los Trabajadores Comerciales y Alimenticios Unidos (UFCW) y Presidente del Consejo Laboral de los Condados de San Diego-Imperial. Kasparian ha sido demandado tres veces por ex personal y personal actual. Las demandas incluyen el acoso sexual, la discriminación contra la mujer, y un ambiente de trabajo hostil y con represalias.

Nos solidarizamos con las tres valientes compañeras, Sandy Naranjo, Isabel Vázquez, y Anabel Arauz, por tener el valor de luchar contra las injusticias en sus lugares de trabajo. Los líderes sindicales hipócritas que profesan luchar por los derechos de lxs trabajadorxs y en su lugar explotan a lxs trabajadorxs no son diferentes a los políticos que profesan apoyar a la comunidad pero que en vez llenan sus bolsillos con los lucros de las prisiones privadas.

El 1ro de mayo tiene más importancia que la celebración de las contribuciones y el valor que los trabajadores de todo el mundo han hecho para mejorar la vida de millones de personas. Podemos celebrar las contribuciones de los trabajadores sin tener que aceptar a los líderes sindicales y comunitarios que explotan a su propio personal. Necesitamos que  se responsabilicen ante la comunidad los líderes sindicales de SEIU-USWW SD, UFCW Local 135 y cualquier otro sindicato u organización comunitaria que crea un ambiente hostil para sus propios trabajadorxs y miembrxs. Hay demasiado trabajo delante de nosotrxs– nuestra unidad deber ser verdadera y no superficial. Nuestra lucha por la justicia tienen que incluir la justicia en nuestras propias comunidades al igual como incluye las luchas nacionales e internacionales.

Luchemos contra todas formas del capitalismo, no importe con que cabeza de la hidra decida mostrarse.
