Being of lawful age and in consideration of being permitted to participate in the kayak rental or tour, the Participant releases and forever discharges the Horned Owl Kayaks, its employees, Jason Barnabe, his spouse, heirs, executors, administrators, legal representatives and assigns from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the kayak rental or tour and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of Horned Owl Kayaks. **The Participant understands that the Participant would not be permitted to participate in the kayak rental or tour unless the Participant agreed to this term.

The Participant acknowledges that the Participant does not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent the Participant from participating in the kayak rental or tour. If required, the Participant will obtain a medical examination and clearance. **The Participant understands that the Participant would not be permitted to participate in the kayak rental or tour unless the Participant agreed to this term.

Efforts will be made by Horned Owl Kayaks to choose a suitable time for the kayak rental or tour. Due to weather, water levels, or other factors outside of Horned Owl Kayak's control, the kayak rental or tour may not be possible. In such a case, efforts will be made to reschedule the kayak rental or tour. The Participant agrees to provide Horned Owl Kayaks with at least 3 hours notice if the Participant will be unable to present themselves at the agreed time and place for the kayak rental or tour. In the event the Participant does not present themselves, or in the event the Participant provides Horned Owl Kayaks with less than 3 hours notice, the Participant agrees they will not be entitled to an alternate date for the kayak rental or tour. The Participant understands that as payment for the kayak rental or tour is made by a donation to a charitable organization, refunds are not possible. **The Participant understands that the Participant would not be permitted to participate in the kayak rental or tour unless the Participant agreed to this term.
