Fresh Fest 2019 Brewery Application
Thank you for your interest in Fresh Fest Beer Fest (Fresh Fest 2019) on August 10, 2019! The two-stage event will be held at Nova Place and Alloy 26, 100 South Commons, Pittsburgh, Pennsylvania 15212 on Saturday, August 10th from 12-9 pm. Most brewers will pour from 3-9 pm.

Please take a moment to fill out this application form. There are limited spaces available, so regretfully, we may not be able to invite all brewer applicants. Applications must be received by March 31.

Fresh Fest welcomes Black brewers as well as other brewers working in collaboration with Black brewers, businesses and artists. At last year’s festival, collaborations included new brews, label designs and food pairings.

Electricity/Special Vendor needs
Each Fresh Fest vendor will receive the use of one 10x10 tent, one 8 ft. table and 2 chairs. Ice and brew tubs are also provided for breweries. We encourage you to decorate your booth with a linen, additional signage and marketing materials. Please let us know any special vending needs that you may have, and if you need power for your booth.

Event Participation Agreement
Fresh Fest Beer Fest takes place from 3:00PM to 9:00PM on Saturday, August 10th, 2019. All breweries shall provide free samples to guests for their participation in the event. No monetary exchanges shall be made between event guests and breweries in return for sampled products. Promotional items EXCEPT FOR BEER OR FOOD may be sold to guests and is encouraged. We ask that each participating brewer bring at least 2 beer styles and a minimum of 2 half bbl of beer to provide at least one sample for everyone. You must have your booth staffed for the duration of the event. All staff must comply with all Allegheny Health Department food, preparation, transportation, storage, and serving regulations as applicable. If you need our volunteers to assist you, please let us know ASAP. The volunteers provided by Fresh Fest cannot serve alcoholic beverages. Promotional Items: You may distribute your own promotional items and marketing materials, but you may not fill and serve alcoholic beverages in any serving receptacle other than the Fresh Fest taster glasses provided by the event. Each guest will be given a tasting cup that holds up to 5.5 ounces of beer, but we ask that the samples be distributed at around 4 ounces each. Fresh Fest will provide each Vendor with a 10x10 tent (outdoor only), table, 2 chairs, complimentary ice/keg buckets (if applicable), inclusion in Fresh Fest advertising, and all compostable materials at no charge to the brewery. However, all breweries must arrive self-sufficient in terms of electricity unless otherwise formally requested when returning this completed and signed agreement to Fresh Fest Beer Fest. Fresh Fest Beer Fest and Nova Place have sole discretion to reject any applicant for any reason whatsoever. Please provide a copy of your CERTIFICATE OF INSURANCE as well as evidence of WORKERS' COMPENSATION insurance if you are bringing employees who will be paid.

Terms & Conditions
SPACE ASSIGNMENTS - Fresh Fest Beer Fest shall use reasonable efforts to designate brewery booths in an acceptable area. Notwithstanding the above, FFBF reserves the right to change Booth location assignments at any time, as it may in its sole discretion deem necessary. TYPES OF EXHIBITS - Exhibits shall be limited to suppliers of goods and services pertinent to the scope and subjects of the Event, as determined by FFBF. A schedule for setup and removal of exhibits will be provided and must be adhered to by the time and date outlined therein. FFBF shall have the right to exclude or to require modification of any Booth display or demonstration which, in its sole discretion, it considers unsuitable to or not in keeping with the character of the Event. FFBF shall have the right to prohibit the use of amplifying equipment or music which, in its sole discretion, it considers objectionable. LIABILITY - This Agreement shall not constitute or be considered a partnership, employer-employee relationship, joint venture or agency between FFBF and Vendor. Brewery shall indemnify, defend, and hold harmless Fresh Fest Beer Fest, Real Fresh Media, LLC, Nova Place, their parent corporations and affiliates and their respective officers, directors, employees and representatives, and the successors and assigns of any of them, from and against, and reimburse them for, all claims, damages, costs and expenses, including, without limitation, interest, penalties, court costs and reasonable attorneys’ fees and expenses, arising out of or resulting from (a) any breach by Vendor of any representation, warranty, covenant, obligation or other arrangement contained in this Agreement; (b) any failure of Vendor to comply with any applicable laws, statutes, ordinances; regulations or rules and regulations of the Venue; (c) any act or omission or negligence of brewery or it's employees, agents, contractors or invitees; (d) any claim for personal injury or property damage in connection with activities conducted in and around brewery’s booth; (e) any announcements, advertisements or other commercial copy produced, provided or approved by Vendor for broadcast on a station owned by FFBF or it's affiliates, including proceedings or litigation alleging infringement, unlawful use or violations of copyright; and/or (f) any defect, alleged or real, in any of brewery’s products sold or provided as samples whether by brewery or by FFBF. The foregoing indemnities shall survive the termination of this Agreement. CANCELLATION OR POSTPONEMENT OF EVENT - In the event of any occurrence outside FFBF's control that results in the cancellation of the Event, the obligations of the parties under this Agreement shall be automatically terminated. FFBF shall not be liable for any loss or damage to Vendor which may be caused by or associated with any postponement or cancellation of the Event. SECURITY/INSURANCE – Neither FFBF nor the Venue Nova Place assumes any responsibility for the safety of the property of brewery, his agents, or employees, from theft, damage by fire, accident, or any the cause. COMPLIANCE - Brewery assumes all responsibility for compliance with all pertinent ordinances, regulations and codes of duly authorized local, state and federal governing bodies concerning rules and regulations and the display rules and regulations issued by FFBF and/or Venue. UNIONS - Brewery will abide by and comply with rules and regulations concerning local unions having agreements with Venue or with authorized contractors employed by FFBF. NONDISCRIMINATION STATEMENT. FFBF and its stations do not discriminate in advertising contracts on the basis of race or ethnicity, and will not accept any advertising which is intended to discriminate on the basis of race or ethnicity. Brewery represents and warrants that it is not intending to discriminate on the basis of race or ethnicity.
