The space will be utilized for the said purpose only.
The rooms will be available 5min prior and 5min after the actual rental times.
Break times are deductible from the rental hours if the building is completely vacated by your group during those times, and the office needs to be notified of the break times at the time of signing the agreement.
Any and all cancellations should be made 72 hours prior.
Any requests for changes in dates should be requested two weeks prior.

BUILDING USE/RENTAL AGREEMENT
The undersigned further agrees to the following:

Terms and Conditions
a) Long-term rentals (rentals consisting of 5 or more individual rentals annually) must be prepaid monthly. Payments must be received by the 1st of each month.  There will be a grace period until the 7th of the month. A $40 fee shall be charged for all checks returned for insufficient funds. All payments must be made payable to CENTER FOR PERFORMANCE ARTS AND LEARNING.

b) Payment schedule: A $20.00 late fee will be charged if payment is not received by the 7th of the month. A $50.00 late fee will be added for payments received after thirty 30 days and a second 30 day period thereafter. After payment is missed for 60 days there is an end of any rentals and withholding of any goods belonging to the renter until payment is received. Return of goods will resume on full payment of any and all fees. Rental will resume at the discretion of the Business Manager.

c) The fee for a cancelled session is 100% of the total cancelled session. A cancelled session is one that has not been signed off on by both parties and has an exact date and time. There is no charge for cancellation due to weather. In the event of cancellation due to bad weather, the renter must call and discuss cancellation with the Business Manager. Cancellations must be requested and agreed upon by the business manager 72 hours in advance.

d) All payments and other added fees (such as late fees, cancellation fees, etc.) are charged immediately to the given credit card 60 days after the rental due date if not paid.

e) Studio premises are monitored by cameras for the safety of our renters and property and will be used in the event of any disputes, claims, damages, etc.    
                                 
g) One-hour rental will be for 50min of actual use with 10min for setup and tear down of equipment, chairs, tables, sweeping, clean up, vacuuming. All food trash and food debris from your group must be removed from the building prior to vacating the building after each day’s use.

h) It is the responsibility of the renter to control the members of their group. If anyone from the renter’s group uses areas of the facility other than the agreed upon rooms, a minimum of one hour’s payment for said room will be assessed and added to the renter’s bill.

l) CENTER FOR PERFORMANCE ARTS AND LEARNING is not responsible for any items belonging to the renter, which are stored or left in the building and become damaged, lost, or stolen. All items in the lost and found will be held for approximately 60 days. At that time, items that have not been claimed will be donated to the local donation center. (Cell phones, clothing etc…)

m) Damages to the building, equipment or property shall be reported immediately to the Business Manager and all costs associated with repairing/restoring shall be the responsibility of the renter. Any bills associated with these issues will be sent to the renter and will be automatically charged if not paid 30 days after the due date.

n) The Business Manager shall be responsible for opening/closing as well as locking the building unless otherwise agreed. The renter is responsible for turning off all lights and closing the door(s) when leaving the building.

o) The renter, as well as other participants associated with this Building Use/Rental Contract, agrees to hold CENTER FOR PERFORMANCE ARTS AND LEARNING Inc harmless from all liability. Renter warrants that all participants will have signed waivers and have them on file before they use CENTER FOR PERFORMANCE ARTS AND LEARNING (28243 Beck Road, Unit B-2, Wixom, MI - 48393)

p) It is the responsibility of the renter to return all chairs, tables, cleaning tools, etc. to the carts or rooms where they were taken from and put in the order they were found originally. This includes the cleaning of all rooms used, including bathrooms. Failure to do so will result in a $50 cleanup fee is added to the renter’s bill.

q) This agreement may be revoked by either party with 30 days’ notice in writing or terminated immediately by CENTER FOR PERFORMANCE ARTS AND LEARNING for breach of the above terms, conditions and agreements. CENTER FOR PERFORMANCE ARTS AND LEARNING further reserves the right to revoke this contract at any time for any reason we deem sufficient with no explanation necessary.

Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement
In consideration of my use of facilities and/or services provided at CENTER FOR PERFORMANCE ARTS AND LEARNING (28243 Beck Road, Unit B-2, Wixom, MI - 48393), I represent that I understood the nature of the activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participations in the activity.

I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis, and death, which may be caused by my own actions, or inactions, those of other participants in the event, the conditions in which the event takes place, or the negligence of the “releases” named below; and that there may be other risks or responsibility for losses, costs, and damages I incur as a result of my participation in the Activity.

I hereby release, discharge and covenant not to sue CENTER FOR PERFORMANCE ARTS AND LEARNING, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place, (each considered on of the “RELEASEES” herein) from al liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “releases” or otherwise, including negligent rescue operations; and I further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the releases, I will indemnify, save and hold harmless each of the releases from any loss, liability, damage, or cost which any may incur as the result of such a claim.

I have read the RELEASE AND WAIVER LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMNT, understand I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend to be a complete and unconditional release of liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in the full force and effect. This agreement is effective at all times subsequent to the date of its execution unless rescinded by an express writing sent to the above by certified mail.

Parental Consent

AND, I the minor’s parent and/or legal guardian, understand the nature of the above referenced activities and the minor’s experience and capabilities and believe the minor to be qualified to participate in such activity. I hereby release, discharge covenant not to sue and agree to indemnify and same and hold harmless each of the releases from all liability, claims, demands, losses, or damages on the minor’s account caused or alleged to have been caused in whole or in part by the negligence of the Releases or otherwise, including negligent rescue operations, and further agree that if, despite this release, I, the minor or anyone on the minor’s behalf makes a claim against any of the Releases, I will Indemnify, save and hold harmless each of the releases from an litigation expenses, attorney fees, loss liability, damage, or cost any Releases may incur as the result of any such claim.

Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health  Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person  contact. It has been reported that many people with COVID-19 do not display any symptoms and, being  unaware of their condition, can unwittingly transmit the virus to others. As a result, federal, state, and  local governments and federal and state health agencies recommend social distancing and have, in many  locations, prohibited the congregation of groups of people.  
Center for Performance Arts and Learning (“CPAL”) has implemented various measures intended to  reduce the spread of COVID-19. Unfortunately, though, Center for Performance Arts and Learning cannot provide assurance that you or your child(ren) will not become exposed to or infected with COVID 19 during your visit to our premises. Despite our mitigation efforts, attending services at CPAL or  utilizing our facilities could increase your risk and your child(ren)’s risk of contracting COVID-19.  
By signing below, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk  that my child(ren) and I may be exposed to or infected by COVID-19 by attending services at CPAL or  utilizing our facilities and that such exposure or infection may result in personal injury, illness, permanent  disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at  CPAL may result from the actions, omissions, or negligence of myself and others who may be present at  CPAL’s facilities from time-to-time, including, employees, volunteers, studio members, visitors, facility  renters, program participants and their families. I agree to assume these risks, and I accept sole responsibility for and agree to release CPAL from any injury, illness, exposure to or infection with  COVID-19, damage, loss, claims and liability of any kind that I or my child(ren) may experience or incur  due to my and my child(ren)’s presence in or use of CPAL’s facilities and participation in CPAL’s  services, programs or activities.

The goal of CENTER FOR PERFORMANCE ARTS AND LEARNING (CPAL) is to

leaders and citizens of the community as well. We seek to maintain a peaceful, uplifting
environment marked by an attitude of honor and respect. Character is defined as the
inward motivation to do what is right no matter the cost and it is our desire to serve the
community by exhibiting that type of character to the community. If you, too, are

our services to you for conferences and special events.
In order to fulfill our goal, we are committed to conducting ourselves with the highest
standards of character and we ask our Event Hosts and patrons to join us in maintaining

• CENTER FOR PERFORMANCE ARTS AND LEARNING is a smoke-free and
alcohol free facility. We strive to maintain a fresh, healthy atmosphere in which
people conduct themselves with dignity and respect. We firmly believe that
keeping our facility free of smoke and alcohol carries us toward this goal.

• It is prohibited to wear marking/street shoes in the CENTER FOR
PERFORMANCE ARTS AND LEARNING dance rooms. If it is found that
anyone from your group has left markings in the studio space, you will be held
responsible for fees associated with repairing/restoring CENTER FOR
PERFORMANCE ARTS AND LEARNING property.

Photograph and Publicity Release Form
I give Center for Performance Arts and Learning, permission
to use my name, likeness, image, voice, and/or appearance as such may be embodied in any pictures,
photos, video recordings, audiotapes, digital images, and the like, taken or made on behalf of Center for
Performance Arts and Learning activities/programs. I agree that Center for Performance Arts and
Learning have complete ownership of such pictures, etc., including the entire copyright. These uses
include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions,
publications, advertisements, and any promotional or educational materials in any medium now known or
later developed, including the Internet. I acknowledge that I will not receive any compensation, etc for
the use of such pictures, etc., and hereby release Center for Performance Arts and Learning and its agents
and assigns from any and all claims, which arise out of or are in any way connected with such use.
