By signing this document, I acknowledge that my presence at the above-referenced property (the “Property”) involves inherent risks, both natural and manmade, and that I have been advised of the following conditions:

I understand that the lake adjacent to the Property is owned, maintained, and controlled by the Homeowners’ Association (HOA) and not by the homeowner(s).
I acknowledge:

• The lake may be accessed from or near the Property, but is not owned or supervised by the Property Owner(s).
  

• A designated portion of the lake may be lifeguarded during specific hours; outside of those times and areas, there is no supervision or safety monitoring.
  

• I assume all risks related to swimming, boating, fishing, wading, ice skating, and all other water or ice-related activities, including the risk of drowning, cold exposure, falling through ice, or impact injury.
  

I understand that the area may contain wildlife (e.g., bears, snakes, insects) and may be subject to extreme weather (ice, snow, cold, heat, storms). I accept the risks of property damage or bodily injury from such environmental conditions and natural hazards.

I acknowledge the following conditions exist inside the home:

• Electric baseboard heaters that may pose a burn risk, especially to unsupervised children.
  

• A staircase that lacks a banister.
  

• A loft railing with post spacing that is not compliant with current safety codes, though legally grandfathered.
  

I agree to use reasonable caution and supervise all minors under my care while in the home.

I understand that the Property is not childproof, and that it is my sole responsibility to supervise any children or minors accompanying me during my stay. The homeowner is not responsible for ensuring safe conditions for children.

To the fullest extent allowed by Pennsylvania law, I hereby:

• Assume all risks of injury, property damage, death, or loss resulting from or related to my presence at the Property, whether such risks are known or unknown.
  

• Release, waive, and discharge the Property Owner(s) from any and all liability for injury or damages arising from ordinary negligence.
  

• Agree that this waiver covers all claims for myself, my heirs, executors, assigns, and any minor(s) I am responsible for.
  

I understand that this does not release the Property Owner(s) from liability for gross negligence or willful misconduct, as such waivers are unenforceable under Pennsylvania law.

In the event of a medical emergency, I authorize the Property Owner(s) or their representative to seek emergency medical treatment for myself or any minor child in my care if I am incapacitated or otherwise unable to respond.

If any provision of this agreement is found unenforceable under Pennsylvania law, the remaining provisions shall remain in full force and effect. 

This release shall remain in effect for this and all future visits to the Property by the undersigned, unless and until the undersigned provides written notice of revocation to the Property Owners.

6. Lake Naomi Club Liability Notice

“As in most recreation settings, there are inherent risks in the use of the facilities and grounds at Lake Naomi and Timber Trails. Thus there is a risk that you assume when you are involved in the use of any facility or on the grounds of Lake Naomi or Timber Trails. Caution and great care must be taken at all times by you, your family and your Guests in order to avoid injury. The Lake Naomi Club, the Timber Trails Community Association and the Pocono Pines Community Association, their officers and directors, their divisions and their agents have no liability for lakes, pools and grounds safety or for any injury occasioned by your use of the facilities and grounds of Lake Naomi or Timber Trails, or by the activities of other Members, Guests, or others, regardless of whether their presence is authorized or unauthorized. In addition, the Club and Community Associations do not carry any form of Accident/Illness / Death or Dismemberment Insurance on any Club Member or Guest. Club Members and Guests must rely on their individual health and accident insurance policies in the event they are injured at Lake Naomi or Timber Trails.” (Lake Naomi Club Leisure Service Guide 2025)

I will ensure that every member of my party complies with them. I understand that violations may result in HOA or Club fines, suspension of privileges, or being asked to leave the property.
