By booking an event with Earp Distilling Co (EDCo). you are accepting these Terms and Conditions as a binding contract without alteration. Earp Distilling Co. reserves the right to update or alter these terms and conditions. 

‘We’, ‘us’ or ‘our’ refers to 1883 Spirits Pty Ltd t/a Earp Distilling Co ABN 90638026267. ‘You’, ‘participant’ or ‘guest’ refers to the person who has booked and/or paid for the event.

BOOKING TERMS, CANCELLATIONS & RESCHEDULING

Event bookings are not confirmed until a signed booking form and non-refundable deposit has been received. Any enquiries up until this point can not be guaranteed. Event menu choices must be finalised at least 30 days prior to the event. Your final invoice will be charged according to the guest numbers provided 30 days prior to your event. You are not entitled to a refund for reduced numbers after this date. Increasing your numbers within this 30 day period is at the discretion of Earp Distilling Co. and requests must be made in writing.

If a party (“the affected party”) becomes unable, wholly or in part, by force majeure to carry out an obligation placed on it under this Agreement: a. Cancellation of the function is available at the request of the Organiser; b. If cancellation of the function is requested less than 30 days before the function date, any and all payments will be retained by Earp Distilling Co.

PAYMENT TERMS

A 10% holding deposit is required at the time of booking in order to secure the space. A 50% of total invoice amount is due 3 months prior to the event date. The remaining balance is due 30 days prior to the event date, when all other details must be confirmed.

SMOKING / VAPING POLICY

No smoking or vaping is allowed on the premises. The smoking area is 4 metres from the front entrance, no drinks are allowed outside.

ROOM HIRE, MINIMUM SPEND & TIME FRAME OF EVENT

The Room Hire fee is subject to change due to the nature of the event, the set up and pack down required and peak seasons. A quote will be issued based on your event requirements. Maximum capacity of function space is 200 guests for a sit down event and 300 for a stand-up canapé function. Exclusive use of the Barrel Hall is predicated on function size and demand for space. For functions larger than 300 guests, or for exclusive use of the Distillery Bar, a full venue hire will be required. Earp Distilling Co. reserves the right to refund room hire fees and forfeit exclusivity of the space in the instance an event does not reach the minimum capacity requirements (80 guests *not applicable to weddings). If false information is given to Earp Distilling Co. regarding confirmed numbers for an event, organisers will be charged a $100 fee for each person less than the minimum amount that is in attendance. Some exceptions may apply at the discretion of EDCo and must be confirmed in writing. Standard room hire fees cover events up to 6 hours plus an additional 1 hour for bump in. More complex set ups (i.e.: significant changes to layout, wedding ceremonies) may incur additional room hire fees. All externally sourced vendors must liaise directly with EDCo regarding venue information, bump-in and bump-out. All styling, banners or any other externally provided materials used in the event must be removed from the venue at conclusion of the function. Materials left on site for >3 business days past the event’s conclusion may incur a storage fee at EDCo’s discretion.

RESPONSIBLE SERVICE OF ALCOHOL

As a licensed venue, Earp Distilling Co. is required to meet certain obligations in relation to the responsible service of alcohol. In accordance with these obligations, Earp Distilling Co. has the right to refuse entry or reject patrons, at EDCo’s discretion.

MINORS

Anyone under 18 years of age is considered a minor and is required by law to be in the company of a parent or guardian. Minors are to be supervised at all times. Kids meals are available upon request.

VENDORS & ENTERTAINMENT

All vendors associated with the function and event, must have all relevant contact information supplied to Earp Distilling Co. Bump in, bump out and any questions need to be discussed directly between the vendor and Earp Distilling Co. Earp Distilling Co. has a sound system; when using the space exclusively, you can play your own music via a smart device throughout the course of your function at no cost.  Alternatively, you may wish to hire a musician which EDCo can assist with for an additional fee. All externally arranged entertainment needs to be approved in writing by the Earp Distilling Co. team prior to commencement. Earp Distilling Co. retains the right to control the level of music / noise created if deemed necessary. A vendor meal is available upon request for $45 (GST inclusive).

SUPPLYING OWN FOOD

A $3 per person cakeage fee will occur in any instance wherein a cake (birthday, wedding etc.) is brought onto the premises. This cakeage fee includes storage of aforementioned cake, plates and cutlery, cake cut and service to your guests. The supply of additional food items is not allowed, unless previously approved by Earp Distilling Co. in writing. This must be in accordance with the Food Act 2003 (NSW). If approved, you will need to sign a form to indemnify Earp Distilling Co. against any actions, claims, demands, losses, damages or costs arising from the consumption of the food that you have supplied. Whilst every effort will be made regarding food left in Earp Distilling Co’s care, no responsibility can be accepted for the safety of produce stored on site during service periods.

CREATIVE SERVICES

In instances where EDCo has been retained to supply creative services (menus, welcome posters etc.) you are entitled to 2 rounds of reviews. Further revisions may incur a fee.
