First Nations Advisory Committee on Safe Drinking Water
Acting on behalf of Tataskweyak Cree Nation, Curve Lake First Nation, and Neskantaga First Nation, McCarthy Tétrault LLP and Olthuis Kleer Townshend LLP have brought a national class action litigation against the Attorney General of Canada for failing to address prolonged drinking-water advisories on First Nations reserves across Canada.

On July 30, 2021, the Government of Canada agreed to settle the class action for approximately $2 billion in compensation, at least $6 billion in infrastructure funding, and a renewed commitment to ensuring regular access to safe drinking water in class members’ communities.  The settlement also includes the creation a First Nations Advisory Committee on Safe Drinking Water (“FNAC”) to:

- Work with class members to provide oversight, guidance, and recommendations to Indigenous Services Canada to support the development and implementation of forward-looking policy initiatives;
- Contribute to strategic advice and perspectives to Indigenous Services Canada in order to advance long-term sustainability of safe drinking water in First Nation communities; and
- Support the identification and prioritization of funding water and wastewater projects in First Nations communities.

The settlement agreement provides for $20 million dollars in funding for the creation of the FNAC.  The FNAC’s membership shall reflect Canada’s diversity of First Nation Class Member communities, languages, genders, geographies, skills, expertise, and experience with water insecurity.  

On December 22, 2021, the Federal Court and the Court of Queen's Bench of Manitoba issued a joint decision approving the agreement between the parties to settle this action.
