RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

I, the participant, agree to abide by all the rules and instructions given in connection with the Sacred Heart Parish School Car Show (the “Event”).  I am not a vendor at this Event, nor will I attempt to sell or otherwise distribute any materials or goods.

I understand there are certain risks to participating in the Event that the Diocese of Monterey Parish & School Operating Corporation (the “Diocese”) and their directors, officers, employees, partners, affiliates, agents, volunteers and successors, (“Released Parties”) cannot eliminate by using reasonable care, including, among others, the risk of contracting illness, such as COVID-19, risk of harm or injury from other Event attendees, risk of property damage, bodily injury, permanent disability and possible death.  HAVING KNOWLEDGE OF THESE DANGERS, AND FULLY APPRECIATING THE RISKS INVOLVED, I, THE UNDERSIGNED, VOLUNTARILY TAKE RESPONSIBILITY FOR ALL RISKS OF PARTICIPATING IN THE EVENT.

In exchange my participation in the Event, I, for myself and on behalf of my heirs, representatives and assigns, release and hold harmless the Released Parties from all legal and financial responsibility and agree not to sue for any harm or injury of any nature (including economic loss, illness, injury, disability, or death) that I or my personal property, including my vehicle(s), might suffer during or as a result of our attendance at the Event, even if the harm is caused by the negligence of the Released Parties.

To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from (that is to say, I agree to pay or reimburse the Released Parties for) any claims, losses, damage, assessments, fines, expenses, costs, legal fees, and causes of action or penalties of any kind (“Costs”) that the Released Parties have to pay for any claim for loss or injury arising out of or resulting from the actions or omissions of me at the Event; provided, however, that nothing in this Release shall be understood to provide for indemnity of the Released Parties for their sole gross negligence or willful misconduct.

I expressly consent to the Event, and the Diocese, and their agents, using the name, picture, and likeness of me and/or my vehicle(s) as recorded at the Event on May 13, 2023 for the purpose of the Event. I authorize the Event, and the Diocese and their agents, to use, reproduce, exhibit, or distribute the name and likeness of me and/or my vehicle(s) for the above purpose in any communications medium currently existing or later created, including, without limitation, print media, television, and social media platforms.

I, for myself and on behalf of my heirs, representatives and assigns, release and hold harmless the Released Parties, from liability for any appropriation of likeness or use of the name or likeness of me and/or my vehicle(s) for the purpose and communications media described above. I understand that all recordings of the name, picture, and likeness, in whatever medium, of me and/or my vehicle(s) shall remain the property of the Event.

By signing this waiver, I expressly acknowledge that an inherent risk of exposure to COVID-19 exists in any public place where people are present. By attending the Event, I voluntarily assume all risks related to exposure to COVID-19 and agree not to hold the Event or any of their affiliates, attendees, sponsors, vendors or volunteers liable for any death, illness or injury of me, even if caused by the negligence of the Released Parties.

I UNDERSTAND THAT BY SIGNING THIS RELEASE I AM GIVING UP MY LEGAL RIGHT TO SUE THE RELEASED PARTIES AND/OR TO SEEK COMPENSATION FROM THE RELEASED PARTIES FOR ANY INJURIES OR DAMAGES THAT I OR MY PERSONAL PROPERTY, INCLUDING MY VEHICLE(S), MAY INCUR AS A RESULT OF, OR INCIDENT TO, OR OTHERWISE IN CONNECTION WITH THE PARTICIPATION OF ME OR MY VEHICLE(S) IN THE EVENT OR ANY USE AND/OR PUBLICATION OF THE NAME, LIKENESS, IMAGE, VOICE, RECORDING, BIOGRAPHICAL INFORMATION, AND/OR OTHER IDENTIFICATION OF ME OR MY VEHICLE(S) BY ANY OR ALL THE RELEASED PARTIES.

I have read, understand and agree to all the terms in this Release and Waiver of Liability and Indemnity Agreement and am submitting this entry on my own behalf listed below.
