[탄원서] 

존경하는 재판장님.

지난 8월 8일 이집트인 난민 15명이 한꺼번에 법무부로부터 난민 불인정 결정 이의신청을 기각당했습니다.

알리(Hassan ALY Mohamed Shehata), 일긴티(ELGENDY Abdelmohsen Ibrahim Abdelmohse), 카림(Abdalla KARIM Abelaziz Mohamed), 하미드 살림(Selim HAMID SELIM Mohamed Abdou), 무스타파(Elazazi MOUSTAFA Abdelmoneim Mohamed), 마흐무드 카말(Mahmoud KAMAL Moustafa Abouzid), 압둘모네암 호삼(Abdulmoneam HOSSAM HASSAN Fathy), 압둘라흐만 무함마드(Hassanin ABDELRAHMAN MOHAMED Eldesouky), 이슬람 카말(Islam Kamal), 아흐마드 살림(Ahmad Salim), 압둘라 마흐무드(Abdellah Mahmoud Ahmed Elsayed Shalaby), 아메드 무함마드(Ahmed Mohamed Ahmed Eltayeb Rashad),  마하무드 솔리만(Mahmoud Soliman Samir Soliman) 등이 그들입니다.

이들은 2013년 쿠데타로 집권해 수많은 사람을 학살한 이집트의 현 엘시시 정권에 반대하는 활동을 하다가 모진 탄압을 받았습니다. 이들 중에는 시위에 참가했다가 체포돼 몇 년씩 구금되고, 고문받고, 종신형 혹은 수십 년 형을 선고받은 사람들이 있습니다. 수천 명이 학살된 2013년 시위에 참가했다가 머리에 입은 총상이 아직도 남아 있는 사람도 있습니다.

2013년부터 2019년까지 이집트 감옥에서 사망한 정치 활동가가 958명이 넘습니다. 현재 이집트가 심각한 경제 위기를 겪고 있는데도 엘시시 정부는 감옥을 25개나 새로 지었습니다. 이들 중 친구와 가족들이 감옥에 없는 사람이 없습니다.

또, 이들은 이집트에서도 팔레스타인 연대 활동을 했었고, 2023년 10월 7일 가자 전쟁이 시작된 후 한국에서도 팔레스타인 연대 운동에 참가하고 있습니다. 이스라엘을 편들고 있는 엘시시 정부는 이들을 더욱 주목하고 있을 것입니다.

엘시시 정부는 이스라엘군이 라파흐 난민촌을 공격할 때, 팔레스타인인 난민들이 이집트로 넘어오지 못하도록 라파흐 국경을 걸어 잠근 바 있습니다. 또한 이집트에서 팔레스타인 연대 시위에 나선 활동가들을 체포하며 탄압하고 있습니다.

이집트인 난민들이 이집트에서 겪은 탄압과 박해의 위험을 입증할 증거들을 제출했음에도, 한국 법무부는 6년 가까이 시간을 끌다 결국 난민으로 인정하지 않았습니다. 이 때문에 이들은 안정적인 일자리를 구하기도 어렵고, 건강보험도 적용받지 못하며, 본국의 가족들을 만날 수도 없습니다.

이들이 난민 인정을 받지 못하면 한국에서 이집트로 강제 추방될 수 있습니다. 그러면 이집트에서 또다시 탄압받거나 형이 집행될 것입니다.

이들은 이집트에서 충분히 먹고살 수 있는 지위를 모두 포기하고, 자유를 위해서 그리고 지금 이집트에서 갇혀 있는 동료들을 위해서 활동하려고 한국에 왔습니다.

이들이 탄압과 박해의 위험으로부터 벗어날 수 있도록 난민으로 인정해 주실 것을 간곡히 탄원합니다.

On a single day of August 8th, the Korean Ministry of Justice rejected all the appeals against the decision not recognizing refugee status, submitted by Egyptian refugees - Hassan ALY Mohamed Shehata, ELGENDY Abdelmohsen Ibrahim Abdelmohse, Abdalla KARIM Abelaziz Mohamed, Selim HAMID SELIM Mohamed Abdou, Elazazi MOUSTAFA Abdelmoneim Mohamed, Mahmoud KAMAL Moustafa Abouzid, Abdulmoneam HOSSAM HASSAN Fathy, Hassanin ABDELRAHMAN MOHAMED Eldesouky, Islam Kamal, Ahmad Salim, Abdellah Mahmoud Ahmed Elsayed Shalaby, Ahmed Mohamed Ahmed Eltayeb Rashad, Mahmoud Soliman Samir Soliman.

They experienced severe oppression for their activities against the current El-Sisi regime in Egypt, which took power in a coup in 2013 and massacred people. Some of them still have gunshot wound in the head caused during the 2013 protest in which thousands of people were massacred.

More than 958 political activists have died in Egyptian prison between 2013 and 2019. Despite Egypt’s ongoing serious economic crisis, the El-Sisi government has built 25 new prisons. Among them, there is no one who doesn’t have friend or family in prison.

They were active in Palestine solidarity movement in Egypt, and since the Gaza War began on 7 October 2023, they have took action to build solidarity movement in Korea. The El-Sisi government’s hatred toward them will have grown even bigger now because it is siding with Israel.

When the Israeli army drove Palestinians into Rafah and brutally massacred them, the El-Sisi government closed the crossing to prevent refugees fleeing to Egypt. El-Sisi is also arresting and oppressing Egyptian activists who are protesting in solidarity with Palestine.

Even though the Egyptians submitted evidences proving the persecution they experienced in Egypt and the risk of oppression that they face, the Korean Ministry of Justice dragged on for nearly six years and ultimately did not recognize them refugee status. Because of this, they are going through difficult time of finding stable jobs, not being covered by national health insurance and being unable to meet their families in Egypt.

If they hadn’t be recognized as refugees, they could even be deported from Korea to Egypt. Then, they will be oppressed or their prison sentence will be carried out again.

They sacrificed their social status which would have allowed them a decent living, and instead came to Korea to fight for freedom and for their comrades who are currently imprisoned in Egypt.

We implore you to recognize them as refugees so that they can escape the risk of oppression and persecution.
