Release of Liability

Read Carefully – This Affects Your Legal Rights

In connection with my participation in the Brave Because Women’s Retreat taking place from 9/17/2026 to 9/19/2026, (the “Retreat”), I, ______________________ hereby enter into this Release of Liability (the “Release”) as consideration for my being granted access, for the duration of the Retreat, to the buildings, accommodations, fixtures, and facilities of the real property located at 986 Lighthouse Dr., Corolla, North Carolina, 27927 (the “Property”), which is owned by Jennifer and Edward Seguine (the “Property Owners”).

Agreement To Follow Directions. I agree to observe and obey all posted rules and warnings at the Property, and further agree to follow any reasonable oral instructions or directions given by the Property Owners, or the employees, representatives, or agents of the Property Owners.

Assumption of the Risks and Release. I understand that during the Retreat, I will have the opportunity to participate in a number of activities, including, but not limited to, the following: using the pool and hot tub located at the Property, visiting the beach nearby the Property, and using the fitness equipment located at the Property (collectively, the “Activities”). I recognize and acknowledge that there are certain inherent risks associated with the Activities, including, but not limited to, risk of trips/falls throughout the Property, risk of encounters with wildlife on or near the Property, and risk of other similar injuries incidental to participation in the Activities. I assume full responsibility for any personal injury to myself and others resulting from my participation in the Activities. I further release and discharge the Property Owners from any and all liability arising from any injury, loss or damage arising out of (i) my participation in the Activities, and (ii) my use of or presence at the Property, whether such injury, loss or damage is caused by the fault of myself, the Property Owners, or any other third party or parties.

Disclaimer. THE PROPERTY OWNERS HEREBY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS, IMPLIED, STATUTORY, AT COMMON LAW OR OTHERWISE, AS TO THE CONDITION OR HABITABILITY OF THE PROPERTY.

Indemnification. I agree to indemnify and defend the Property Owners against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs, which may in any way arise from my use of or presence upon the Property.

Fees. I agree to pay for all damages to the Property which may be caused by any negligent, reckless, or willful actions by me.

Applicable Law. Any legal or equitable claim that may arise in connection with my use of or presence upon the Property (including my participation in the Activities) shall be resolved under North Carolina law.

No Duress. I agree and acknowledge that I am under no pressure or duress to sign this Release and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Release if I so desire.

Arm’s Length Agreement. This Release and each of its terms are the product of an arm’s length negotiation between me and the Property Owners. In the event any ambiguity is found to exist in the interpretation of this Release or any of its provisions, no rule of construction will apply in the interpretation of such ambiguity to the disadvantage of one party on the basis that such party put forward or drafted this Release or any provision of this Release.

Enforceability. The invalidity or unenforceability of any provision of this Release, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Release or of any other applications of such provision, as the case may be. Such invalid or unenforceable provision shall be deemed not to be a part of this Release.

Dispute Resolution. The parties will attempt to resolve any dispute arising out of or relating to this Release through good faith negotiations among the parties. If the matter is not resolved by negotiation, the parties will submit the dispute to mediation in accordance with any statutory rules of mediation. If mediation does not successfully resolve the dispute, then the parties may proceed to seek an alternative form of resolution in accordance with any other rights and remedies afforded to them at law or equity.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
