Sign on Letter Seeking an Extension of 30-Day Comment Period for Elimination of Duration of Status NPRM
On August 28, 2025, the Department of Homeland Security (DHS) published a Notice of Proposed Rulemaking (NPRM) entitled "Establishing a Fixed Time Period of Admission and an Extension of Stay Procedure for Nonimmigrant Academic Students, Exchange Visitors, and Representatives of Foreign Information Media." (90 FR 42070).  The NPRM seeks to eliminate duration of status admission for F-, I-, and J- nonimmigrants by proposing a complicated transition process and providing a wide variety of fixed admission periods for these individuals.  Despite deeming it a "significant regulatory action" because the rule has significant economic impact and poses complex legal issues, DHS has only offered the public 30 days to provide comment.  This is insufficient to provide meaningful comment.  

This sign-on letter is intended for organizations, educational institutions, companies, and other interested parties planning to submit a comment who believe the 30-day comment period is insufficient to provide meaningful comment.  It requests an extension of the comment period of a minimum of 60 days.  You can read the full text of the comment letter here.
