Subject to the terms and conditions stated below the parties agree as follows:
1. TERM. The lease term will begin on _________________ ("Commencement Date") and shall continue as a month-to-month rental agreement.
2. CONDITIONS.
Pixie Dusted Party owns the costumes, you hire them.
When you hire our costumes, you need to look after them, Please do not wash them, many need specialist care.
In the unlikely event that anything is missing or damaged when your order arrives, you need to photograph let us know right away, within 24 hrs of its arrival.
If you do damage or lose a costume, we will charge you for the replacement.
Fees and Payment
The contractor/performer shall agree to receiving a lower pay scale when using a costume provided by Pixie Dusted Party at the rate of $40 an hour.
If the contractor/performer provides their own approved costume to wear for an event their pay will be increased to $50 an hour.
3. DAMAGES. Any damages to the following items of property provided by the Business will result in a charge to the Tenant as indicated herein:
Speaker: $40
Cosmetic Supplies: $20
Props: $20
4. MAINTENANCE. The business shall have the responsibility to maintain the party gear in reasonably good repair at all times and perform all repairs reasonably necessary to satisfy any implied warranty of habitability.
5. GOVERNING LAW. This Lease shall be construed in accordance with the laws of the State of Arizona.
6. ENTIRE AGREEMENT/AMENDMENT. This Rental Agreement contains the entire agreement of the parties and there are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Rental Agreement. This Agreement may be modified or amended in writing, if the writing is signed by the party obligated under the amendment.
7. SEVERABILITY; WAIVER. If any portion of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. The failure of either party to enforce any provisions of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.
Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation does not successfully resolve the dispute, then the parties may proceed to seek an alternative form of resolution in accordance with any other rights and remedies afforded to them by law.
