through Arbitration: Basketball Arbitral Tribunal and Ex Aequo et Bono

Basketball Arbitral Tribunal (“BAT”) and its default mode of ex aequo et bono decision-making offer a fascinating, if largely underexplored, example of creation of transnational law through arbitration. Starting some twenty years ago, BAT has been a success story in developing a precedent-based jurisprudence. Through creating principles of transnational basketball law, BAT provides both unique insight into what ex aequo et bono means in practice and how transnational legal orders are created. Might it offer lessons and transplants to broader international arbitration world remains, however, less certain and deeply context dependent.

Dr. Velimir Živković, MJur is an Associate
Professor and Director of LLM at University of Warwick School of Law. His research interests include international investment,
commercial and sports arbitration, English and comparative contract law, as
well as broader issues of the rule of law internationally. His book ‘Fair and
Equitable Treatment and the Rule of Law’ came out in July 2023 with Elgar. In
addition to academic activities, Velimir serves as of counsel in commercial,
sports and investment arbitrations and engages in different legal consultancy
activities.
