Liability Waiver for Heartwood Circle
Please read this waiver carefully and ensure you understand its contents before signing.
By checking the box below this document, I, the undersigned parent or legal guardian of the child I am bringing and myself, (hereinafter referred to as "the Parent/Guardian"), acknowledge and agree to the following:
1. Nature of Activities:
I understand that Heartwood Circle (hereinafter referred to as "the Group") organizes and facilitates outdoor support group meetings and activities, which may include, but are not limited to: walking, playing in parks, light physical activities suitable for parents and infants, and general social interaction in outdoor environments. These activities may take place in various outdoor locations, including parks, playgrounds, and other public spaces.
2. Inherent Risks:
I am aware that participation in outdoor activities carries inherent risks that cannot be entirely eliminated, regardless of the precautions taken by the Group. These risks may include, but are not limited to:
Uneven terrain, including but not limited to, bumps, holes, roots, and slippery surfaces.
Weather conditions, such as sun exposure, heat, cold, wind, rain, and potential for unexpected changes.
Insect bites or stings.
Contact with natural elements such as plants, animals, and water sources.
Accidental falls, trips, or collisions with other participants or objects.
Exposure to allergens.
The potential for illness or injury, including minor scrapes, bruises, sprains, or more serious injuries to myself or the Child.
Risks associated with the presence and actions of other participants and members of the public.
Traveling to and from designated meeting locations.
Use of public facilities, such as restrooms and playground equipment.
3. Assumption of Risk:
I voluntarily assume all risks associated with my and the Child's participation in the Group's outdoor activities, whether foreseen or unforeseen. I understand that I am responsible for ensuring the Child's safety and well-being during all activities, including supervising the Child closely and ensuring they are dressed appropriately and have any necessary supplies (e.g., sunscreen, water, snacks, appropriate clothing).
4. Release of Liability:
In consideration for being permitted to participate in the Group's outdoor activities, I, on behalf of myself, the Child, our heirs, executors, administrators, and assigns, hereby fully and forever release, waive, and discharge Heartwood Circle, its organizers, leaders, volunteers, and any affiliated individuals or entities (hereinafter collectively referred to as "the Released Parties") from any and all claims, demands, actions, causes of action, damages, losses, expenses, and liabilities of any kind or nature whatsoever, whether known or unknown, arising out of or in any way connected with my or the Child's participation in the Group's outdoor activities, even if such claims, demands, actions, causes of action, damages, losses, expenses, or liabilities are caused by the negligence or other acts or omissions of the Released Parties. This release includes, but is not limited to, any claims arising from the condition of the premises, the actions of other participants, or the provision of any assistance or advice by the Released Parties.
5. Medical Care:
I understand that the Released Parties do not provide medical care. In the event of an accident or illness, I authorize the Group's organizers or designated individuals to administer basic first aid if deemed necessary and to contact emergency medical services if they believe it is warranted. I agree to be solely responsible for all medical expenses incurred by myself or the Child.
6. Personal Responsibility:
I acknowledge that I am responsible for my own and the Child's conduct during the Group's activities and agree to abide by any guidelines or instructions provided by the Group's organizers. I will ensure that the Child behaves in a safe and respectful manner towards others. I am responsible for maintaining control of my child and preventing them from engaging in any behavior that could endanger themselves or others.
7. Severability:
If any provision of this waiver is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
8. Governing Law:
This waiver shall be governed by and construed in accordance with the laws of the State of California.
