政府由3月28日起針對飲食業實施6項「無理辣招」,為期14日,但這些措施非常「離地」,完全不了解香港飲食業生態。這6項「無理辣招」生效以來引起的問題眾多,我們必須指出原有餐廳格局難以符合有關桌子擺放的規定,令到食肆被迫承受違規及被起訴的風險。

此外,我們認為食客必須在飲食時間外佩戴口罩是不切實際的規定,政府亦沒有就「飲食時」作出清晰定義,食客不清楚如何在用餐過程符合規定,餐廳職員亦難以時刻監察食客的用饍情況。政府將這個規定的法律責任落於食肆之上,絕不合理。

政府部門未有詳細解釋法例內容,很多餐廳負責人都不理解相關要求卻求助無門。食環署及警務署卻在過去數日在模糊地帶下展開巡查行動,政府部門的高調行動不但對食肆構成壓力,亦對食客造成極大滋擾。我們認為政府必須加強在源頭堵截病毒,才可控制疫情。飲食界願意配合有效及清晰的防疫措施,但政府只諮詢大集團的意見,漠視中小企食店落實措施的困難。

飲食業界樂意同港人同行,一起渡過疫症難關,但我們認為政府及飲食界立法會議員張宇人共議下推出6項「無理辣招」無助控制疫情,只會進一步打擊飲食業的生意。對於林鄭月娥及張宇人訛稱措施有效,我們感到憤怒及遺憾。

我們要求政府盡快回應業界5項訴求:

1. 全面封關堵截病源,加強檢疫防止擴散。
2. 必須在「無理辣招」14日到期前,與業界中小企會面,了解他們的處境及解釋「無理辣招」的模糊地帶。
3. 就「無理辣招」對飲食業造成的傷害,向食肆提供補償。
4. 若「無理辣招」生效14日後未能紓緩疫情,政府應規定全港食肆停業並全數賠償租金、薪酬等成本開支。
5. 承諾不會檢控及起訴因不清楚法例內容而違規的食肆。

Petition from F&B industry stakeholders to protest against irrational regulations and call the 5 demands to compensate, ease the pandemic and explain the regulation

Headline: Irrational and Unclear Regulations only Claim to be effective

From March 28, the government implemented six regulations for the catering industry for 14 days, but these measures were very "off the ground" and did not understand the ecology of the catering industry in Hong Kong. These six regulations have caused a lot of unnecessary problems since they came into effect. We must point out that the lots of restaurants original table settings/ floor plans could not meet the new table placement requirements , which forced restaurants to bear the risk of law violations and face prosecutions.

Besides, we consider that it is impractical to allow diners not to wear masks only during eating or drinking, and the government has not clearly defined "during eating or drinking". Diners do not know how to meet the measure taken during the meal, and restaurant staff can hardly monitor every single customer all the time. It is unreasonable for the government to place this legal enforcement responsibility on restaurants.

Hence, the Government did not explain the content of the legislation in detail, and many restaurant owners did not understand the relevant requirements, yet find it difficult to asked for help. The FEHD and the Police Force have launched inspections in the past few days in a vague area. High-profile actions taken by these government departments have not only put pressure on restaurants, but have also caused great nuisance to diners. We believe that the government must step up to fight against the virus at its source to control the epidemic. The catering industry is willing to cooperate with effective and clear epidemic prevention measures, but the government only consults the opinions of big F&B groups and ignores the difficulty of implementing measures by SME restaurants.

The F&B industry is willing to stand with Hong Kong people to overcome the epidemic, but we believe that the introduction of the six irrational regulations by the government and legislator Tommy Cheung will not help control the epidemic and will only plunge the industry hard. We are angry and strongly disagreed that Carrie Lam and Tommy Cheung claimed the measures were effective.

We ask the government to respond to the five demands of the industry as soon as possible:

1. The government’s efforts should instead be focused on enhancing supervision of returnees to Hong Kong who were now quarantined at home, as well as further restrictions on people crossing the borders should be limited to only Hong Kong residents and screening everyone.
2. Before the irrational regulations expire on the 14th, the Government must meet with SMEs in the industry to understand their situation and explain the vague areas of the six regulations.
3. Provide compensation to restaurants for the six regulations that have caused damage to the catering industry.
4. If the six regulations fail to ease the epidemic 14 days after the effective date, the government should require all restaurants in Hong Kong to close down and fully compensate for costs such as rent and salary.
5. Pledge not to prosecute restaurants that have violated regulations due to unclear content of the law.
