TERMS & CONDITIONS for library use and multiple educational screenings
The organization (“Licensee” named in the second question on this form) recognizes a contractual agreement for a multiple use license for the limited, non-broadcast, classroom, student organization, and educational public exhibition of the documentary film entitled UNTOUCHABLE ("The Film"). This license includes the right to add the film to the library or organization's collection.
The Licensee agrees that he/she shall pay to Panopticon Productions LLC ("Licensor") a licensing fee, agreed upon via email, which shall become due and payable immediately upon receipt of this agreement. In consideration of payment of the license fee provided for above, the Licensor hereby grants to the Licensee, without warranty, a limited, non-transferable license to screen The Film, subject to the terms and conditions specified herein.
Purchase of license is for educational projection and playback for the life of the DVD or BluRay. This license only permits screenings presented and hosted by the licensee, and does not include screenings in which admission fees are charged. (If you would like to negotiate terms for a screening at which admission is charged, please email us to discuss.)
THE FILM is fully protected by U.S. Copyright laws. Under the terms of this agreement, purchase, rental or preview of a DVD or BluRay of THE FILM does not include or imply the right to sell, rent, loan, sublease or sublicense to others. THE FILM may not be digitized, altered, transmitted, duplicated or reproduced by any means without prior written authorization from Panopticon Productions. This license specifically excludes any digital or analog transmission or duplication of the program in whole or in part by broadcast, narrowcast, internet, intranet, open-cable, direct broadcast satellite, or other means, or to any off-campus, distance learning, or affiliate site without written permission of Panopticon Productions.
Geographical restrictions: Uses defined in this license are limited to a single campus or principal place of presentation within 25 miles of the purchaser’s address.
These Terms and Conditions are governed by the laws of the United States. Purchase of this license means that purchaser agrees to all terms and conditions stated herein, without reservation or amendment. Any state or federal action arising out of this Agreement shall be brought in New York, or any other state or federal district court having jurisdiction to hear any dispute arising out of this Agreement.
