This Release and Waiver of Liability (the “Release’) executed on this day on behalf of the minor child (hereinafter “the Player”), by the parent having legal custody and/or the legal guardianship of the Player (hereinafter “the Guardian”), releases FC La Isla also known as La Isla (hereinafter “La Isla”), a soccer academy and each of its coaches, employees, and/ or agents.
I, the Guardian, of the above named Player, do hereby give my consent to his/her participation in all La Isla games, activities, programs, and/ or events. The Player and the Guardian desire that the Player engage in activities related to serving or participating in La Isla games, activities, and/ or events. I understand, acknowledge and agree to the following:
1.Waiver and Release: We, the Player and the Guardian, Release and forever discharge and hold harmless La Isla and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which may arise or may hereafter arise from the activities as a player in La Isla, including claims arising out of negligence. We understand and acknowledge that this Release dischargesLa Isla and its successors from any liability or claim that we may have against La Islawith respect to bodily injury, personal injury, illness, death, or property damage that mayresult from the Player’s involvement in La Isla activities.
2.Insurance: I, the Guardian, affirm that the Player is covered by primary medical insurance and understand that I am responsible for the Player’s medical bills if injury may occur with the Player’s involvement with La Isla activities. Further, I understand that La Isla does not assume any responsibility for or obligation to provide the Player with financial or other assistance, including but not limited to medical, health or disability benefits or insurance of any nature in the event of the Player’s injury, illness, death, or damage to his or her property. We expressly waive any such claim for compensation or liability on the part of La Isla beyond what may be offered freely by La Isla in the event of such injury or medical expenses incurred by the Player.
3.Assumption of the Risk: I, the Guardian, acknowledge and fully understand that the player, will be engaging in activities that involve risk of serious injury, including permanent disability and death, property loss and severe social and economic losses.These risks include, but are not limited to, those caused by: (a) the actions, inactions or negligence of La Isla, other participants, volunteers, spectators, coaches, event officials, referees and organizers; (b) conditions of the premises, facilities or equipment used; (c)rules of play; (d) weather conditions; (e) the skill, ability and condition of other participants, and their failure to abide by the rules, regulations, terms and conditions for participation in the program, event or activity; and (f) vehicular traffic. I further acknowledge and fully understand that there may also be other risks that are not known or foreseeable at this time. La Isla cannot control these risks, nor has La Isla judged the player’s skill level or ability prior to allowing the player to participate and consequently is not in a position to guarantee the player’s personal health or safety during participation in the games, events or activities. I KNOWINGLY, INTELLIGENTLY AND VOLUNTARILY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, ANTICIPATED AND UNANTICIPATED, FORESEEABLE AND UNFORESEEABLE, EVEN IF ARISING FROM THE NEGLIGENCE OF LA ISLA OR OTHERS, AND I ASSUME FULL RESPONSIBILITY AND LIABILITY FOR THE PLAYER’S PARTICIPATION.
4.COVID: I, the Guardian, understand that: (a) the novel coronavirus, COVID-19, hasbeen declared a worldwide pandemic by the World Health Organization and that COVID-19 is extremely contagious and is believed to spread from person-to-person contact andpotentially through airborne transmission; (b) it is believed that an individual can beinfected with COVID-19 without their knowledge and be asymptomatic; (c) La Isla hasput in place preventive measures to reduce the spread of COVID-19 but La Isla cannotguarantee that I or anyone else will not become infected with COVID-19, including myspouse, roommates, guests, unborn child, or relatives; and (d) participation in La Islagames, events, or activities, could increase the risk of contracting COVID-19. By signingthis agreement, I ACKNOWLEDGE the contagious nature of COVID-19 andVOLUNTARILY ASSUME THE RISK that I may be exposed to or infected by COVID-19 by participating in la Isla games, events, or activities, and that such exposure orinfection may result in personal injury, illness, permanent disability, and death to myself,my spouse, roommates, guests, unborn child, or relatives. I understand that the risk of becoming exposed to or infected by COVID-19 at La Isla games, events, or activities may result from the actions, omissions, or negligence of myself or others, including, but not limited to, La Isla coaches, employees, volunteers, and program participants. IUNDERSTAND AND VOLUNTARILY ACCEPT AND ASSUME ALL the foregoingrisks related to COVID-19 and accept sole responsibility for any injury or illness thatmay occur. Further, I UNDERSTAND AND AGREE that this release includes anyClaims based on the actions, omissions, or negligence of La Isla, its employees, agents,and representatives, whether a COVID-19 infection occurs before, during, or afterparticipation in any La Isla games, events, or activities. Further, I agree that I will notparticipate in La Isla games, events or activities if I am not feeling well and that byattending any La Isla games, events or activities I am certifying each time that: (a) I amnot experiencing any COVID-19 symptoms, including, but not limited to: fever, cough,shortness of breath/difficulty breathing, chills, muscle pain, sore throat, new loss of tasteor smell, persistent pain or pressure in the chest, inability to wake or stay awake, bluishlips or face; (b) I have not tested positive for COVID-19 in the past 14 days; and (c) I have not had close contact with a confirmed or suspected COVID-19 case in the past 14 days.
5.Photographic Release: I, the Guardian, hereby grant to La Isla and those acting with itsauthority, the right to photograph, videotape, or otherwise capture or collect the player’svoice and sounds (hereinafter “the Content”) during the player’s participation in La Islagames, events or activities. I further acknowledge and grant all the Content to La Isla andthe right to use or sublicense the Content and the Player’s name, likeness, and biographyin La Isla’s discretion, in all media and in all forms and for all purposes, includingwithout limitation, advertising and other promotions for La Isla, without any furtherconsideration to me or any limitation whatsoever.
6.I, the Guardian, hereby intend that this Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
7.I, the Guardian, have read this waiver and release of liability carefully and I fully understand its terms, and I understand that I have given up substantial rights by signing this document, and I sign it knowingly, intelligently and voluntarily without any inducement or duress.
8. I, hereby consent to receiving communications from FC La Isla via email, text and postage mail and understand that I will be added to the company mailing list
