We, the undersigned Fishkill residents, submit the following request for consideration by the Town Board of the Town of Fishkill:

That the Town Board adopt a Resolution authorizing the town’s legal representatives to commence court proceedings seeking to reverse the ruling in a 2022 case ordering the Town to extend water and sewer district extensions to the GLD3/Continental Commons property, owing to recent indications that there is not sufficient water capacity to accommodate this extension.

We feel this Resolution is appropriate, as the cost of this litigation would be lower than the cumulative ongoing additional expense to Fishkill taxpayers, to purchase the additional water needed to ensure adequate capacity for the indefinite future.
