This presentation is a primer on how to make the most of cell phone extraction reports generated from Cellebrite software. Want to know more about the components that make up an extraction report and how to easily view and navigate the detailed and voluminous report? The session will help you to quickly identify relevant data, discover more leads and create customized reports. Also discussed will be the different levels of extractions and extraction report formats so that you know if you received through discovery all the essential components that make up the complete extraction report.

II. Strategic Use of Video Evidence: Issues of Admissibility, Cross-Examination and Defense Use of Digital Evidence

The presenters will discuss ways to challenge damaging surveillance camera footage in court to either exclude it from evidence or minimize its impact at trial. Issues explored will be video quality, evidence manipulation, and chain of custody. Additionally, this presentation will explore ways for the defense to use digital evidence as either exculpatory or mitigating evidence at trial. The discussion will include a practical review of easy methods for gathering, organizing, and reviewing lengthy video footage. If time permits the presenters will also show you how to quickly create a short video clip from the footage for use as an exhibit to make your point with a critical witness or as demonstrative evidence for use during your closing argument. Come learn about the many ways to comfortably manage this type of evidence in your case.

III. Cross-Examination Techniques: Bias, Corruption and Other Forms of Attacking the Witness
Presenter: Mani Golzari, Training Director, Trial Division, PDS
This session will explore techniques for conducting a winning cross-examination including impeachment and challenging the witness on issues of bias and corruption. The discussion will focus on the scope of the Confrontation Clause, the admissibility of extrinsic evidence when demonstrating witness dishonesty, and the foundational rules for impeachment with either a prior conviction or inconsistent statement. This session will be a cross-examination primer as we all get reacquainted with trials in a post-pandemic world.
