Orion Boat House - Boat Dock Liability Waiver

In consideration of the use of the boat dock facilities at Orion Boat House (hereinafter referred to as “Restaurant”) located in the State of Michigan, the undersigned (hereinafter referred to as “Customer”) hereby agrees to the following:

1. Customer represents that they have a valid MC number for their boat and are legally allowed to operate a boat.
2. Customer acknowledges and agrees that they are responsible for ensuring their boat has valid insurance coverage. Restaurant will not be verifying insurance coverage, and Customer shall bear all responsibility for any losses or damages caused by a lack of insurance.
3. Customer understands that the Restaurant reserves the right to refuse parking at the dock or ask a boat to leave at its sole discretion.
4. Customer agrees to abide by any posted safety guidelines and rules enforced by the Restaurant, including restrictions on boat size and securing larger boats.
5. Customer agrees to adhere to a code of conduct which includes no excessively loud or offensive music, no offensive language, and no harassment of other guests or customers. The Restaurant reserves the right to refuse service for violations of this code of conduct.
6. Customer acknowledges that the Restaurant may, from time to time, host special events, live music, and special gatherings. Customer assumes all risks associated with participating in or attending such events.
7. Customer hereby releases, waives, discharges, and covenants not to sue the Restaurant, its owners, employees, or agents (collectively, the “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury (including death), or property damage that may be sustained by the Customer, or to any other person, while using the boat dock facilities, participating in any activities or events at the Restaurant, or otherwise present on the Restaurant’s premises.
8. The Customer accepts that they are responsible for all of their guests that they bring to the Orion Boat House by boat.
9. Customer hereby indemnifies, defends, and holds harmless the Releasees from any loss, liability, damage, or cost, including reasonable attorney fees, that may be incurred due to the use of the boat dock facilities, participation in any activities or events at the Restaurant, or otherwise being present on the Restaurant’s premises, whether caused by the negligence of Releasees or otherwise.
10. This waiver is valid only for the calendar year 2023.
11. Customer agrees that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Michigan, and that if any portion of this waiver is held invalid, it is agreed that the balance shall continue in full legal force and effect.

By selecting “I agree”, the Customer acknowledges that they have read and understand this Boat Dock Liability Waiver, voluntarily agrees to its conditions, and understands that they are relinquishing substantial legal rights. By proceeding with their reservation or use of the boat dock facilities, the Customer provides their digital consent to this waiver.
