WAIVER, RELEASE FROM LIABILITY, AND IMAGE RELEASE
Waiver of Liability:
In consideration for myself and my minor children being permitted by Chehalem Valley Dance Academy NW LLC (“CVDA”) to participate in activities and classes, I hereby waive, release, and discharge any and all claims and damages for personal injury, death, or property damage which I or my minor children may sustain or which may occur as a result of mine or my minor children’s participation in these activities.
I understand and agree that:
-This release is intended to discharge in advance CVDA, its officers, employees, and agents from and against any and all liability, except for their gross negligence or intentional acts, connected in any way with the participation of myself or my minor children in activities;
-The described activity or class may be of hazardous, strenuous, and/or physical nature;
-Participation in the described activity or class may occasionally result in injury, death, or property damage;
-I hereby assume any and all risks, known and unknown, including but not limited to injury, death, or property damage and to release and hold harmless CVDA, its officers, employees, and agents, except for their gross negligence or intentional acts;
-This waiver, release, and assumption of risk is to be binding on the heirs and assigns;
-I will indemnify and hold CVDA harmless from any loss, liability, damage, cost, or expense, including litigation, which they may incur as a result of any injury and/or property damage which myself or my minor children may sustain while participating in said activities;
-I will make good any loss or damage or cost CVDA may have to pay if any litigation arises on account of any claim made by myself, my minor children or by anyone on said minor’s behalf;
-In the event that said minor requires medical or surgical treatments while under the supervision of said CVDA personnel in connection with the described activity, such supervision may authorize treatment;
-I will pay all medical, hospital, or other expenses which I or my minor children may incur as a result of such treatment;
-I expressly permit said minor child to travel by private automobile to activities and events related to the described activity;
CVDA is not responsible for children prior to or following the dismissal of a program.
CVDA Dance Studio ("CVDA") respects the privacy and confidentiality of its students and their families. This Image Usage Policy outlines the guidelines for the public use of visual and audio images captured within the studio, ensuring that no names are disclosed, and images are exclusively shared on CVDA's social media platforms and utilized for internal marketing purposes.
Severability:
If any portion of the foregoing waiver of liability, assumption of risk, indemnity, and image release agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgment of Understanding:
I have read this release, waiver of liability, assumption of risk, indemnity, and image release agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
