Responsible Dog Owner Day Rescue Contract
At the event, Hobo’s Healing Heart provides a Rescue Center space to all rescue organizations and shelters who wish to participate. To help promote that you are at Responsible Dog Owner Day, your organization is mentioned in Hobo’s Healing Heart promotional materials, new releases and website. We also ask that attendee bring a donation from your wish list to contribute to your mission. Organizations must be a 501(c)3 nonprofit to participate in the event or have filed.
Hobos Healing Heart provides a free 10 foot by 10 foot reserved space. NO electricity is provided.

Rescue Center Rules
Responsible Dog Owner Day is a fundraising event for Hobo’s Healing Heart; therefore, we do ask that your organization
1) Does not solicit for donations while at the event; however you may sell products or goods as approved by Responsible Dog Owner Day event management.
2) Hobo’s Healing Heart asks that the organization being no more than two (2) dogs – please no cats, as the area can become overwhelming and we do not want any animals under a large amount of stress. We also ask that all dogs have had their rabies vaccination.
3) Dogs must be on a leash at all times. Please NO retractable leashes
4) There may or may not be shade for the entire day. Water will be made available for dogs, but the organization may want to bring a tent to provide shade for the animals.
5) Please be aware that there will be other rescues and shelters at this event and you will be in close proximity to one another.

Nonprofit organizations must be a 501(c)3 nonprofit to participate in the event or have filed. Nonprofits cannot host drawings, donations jars, guessing games, lotteries, prize contests of any kind, raffles, silent auctions or the like at your booth at any time during the event. You may, however, sell items or merchandise to raise money for your mission. *

Insurance: Hobo’s Healing Heart has a general liability insurance policy to cover Hobo’s Healing Heart during the Responsible Dog Owner Day Event. This policy, however, does not cover vendors. Each vendor is strongly encouraged to purchase its own insurance coverage sufficient to insure against any possible liability. Liability certificates may be obtained as an insurance rider through your current insurance provider. If you do not have an insurance provider, please visit http://www.actinspro.com – this website is very helpful for event-day liability insurance. *

Sub-letting: No Rescue shall assign or sublet the whole or part of the space allotted, or booth therein, to any programs or services other than those specified in the contract for booth space. Only one company per booth is permitted. *

Sales: Merchandise sales must comply with all local, state, and federal laws and regulations. The sale of pets of any kind is NOT permitted. *

Limitation of Liability All Business partner (Vendors, Sponsors, and Silent Auction and Goodie Bag donators): agree to hold Hobo’s Healing Heart, the City of Belle Fourche Parks and Recreation, Butte County Government, City of Belle Fourche Special Event Facilities, and its agents associated with Responsible Dog Owner Day, harmless and blameless and will make no claim of any reason whatsoever, including negligence, against Event Management, its officers, agents, employees, or the lessors or owners of the Facility for loss, theft, damage or destruction of property, nor for any injury to it or its employees, agents or invites while in the park. *

Equipment: The Rescue may have a 10 x 10 ft., square canopy. Electricity will not be provided by Event Management, except for Food Vendors. **Chairs and tables are the Rescue’s responsibility.** *

Care and Staffing of Booths: The Rescue will be responsible for its own loading, unloading, booth set-up and clean-up of its area. Available Hobo’s Healing Heart volunteers may assist in setting up and taking down the canopies and tables. Rescues MAY bring vehicles into the park to unload merchandise IF the ground is dry enough otherwise, they MUST unload from their vehicles in the street or parking lot and walk everything into the park. ***The Rescue agrees to have its booth staffed and open for business by 9:30 am and will not start tearing down until 3:00 pm*** *

Waste Disposal: The Rescue is responsible for the removal of all trash. This includes breaking down cardboard boxes. A trash can is provided at the parking lot near the public restrooms. *

Compliance with Laws: Rescues shall not engage in any display, publication, performance, or any other activity which is in conflict with any applicable law, regulation, rule or ordinance, nor shall Rescue, or its representatives or employees, engage in any lewd display, publication or performance. Rescue will be responsible for obtaining all necessary governmental permits and licenses. Rescue shall comply with all rules promulgated by the City of Belle Fourche Parks and Recreation. Personal dogs in Rescue booth must be at least one year old, up-to-date on all vaccinations and on a leash – NO retractable leashes or leashes longer than 6 ft. *

No attendance guarantee: Hobo’s Healing Heart does not guarantee specific volumes or level of attendance at the Event. *

Use of Rescue Booth: The Event Management may, at its discretion at any time, use photographs, videos, logos and testimonials of any Rescue for its own public use. *

Impossibility: The performance of this Agreement is subject to termination without liability upon the occurrence of any circumstances beyond the control of either party – such as acts of God, war, government regulations, disaster, strikes (except those involving the employees or agents of the party seeking the protection of this clause), civil disorder, or curtailment of transpiration facilities – to the extent that such circumstances males it illegal or impossible to provide or use the Park facility. The ability to terminate the Agreement without liability pursuant to this paragraph is conditioned upon delivery of written notice to the other party setting forth the basis for such termination as soon as reasonable practical – but in no event longer than ten (10) days – after learning of such basis. *

Amendment to Rules: Any and all matters or questions not specifically covered by the preceding Rules and Regulations shall be decided solely by the Event Management without notice and all amendments so made shall be binding on the business partner. *

Attorney’s Fees/Costs: In the event of the use of an attorney by Event Management to enforce any part of this Contract, all costs, including reasonable attorney’s fees, will be paid by the Business Partner. *

Entire Contract: This instrument contains the entire Contract between the parties relating to the subject matter hereof. The parties have made no contracts, representations or warranties, relating to the subject matter here of which are not set forth herein. Failure to enforce any provision hereof by Event Management shall be deemed as a waiver with respect to such provision after demand by Event Management for the strict performance of this agreement. No modification to this Contract shall be valid unless made in writing and signed by the parties hereto. *

Acceptance: This document shall not constitute a contract between the parties until acceptance by the Event Management.
