This form must be completed and signed by each Participant or Participant’s Parent/Guardian (if under 18).

By signing this Liability Release and Waiver (“Waiver”), the individual who has offered their legally binding esignature below (“Signee”) wishes to participate in the Open Gym from September 2024 through September 2025 (“Event”). The Signee recognizes that there are risks of damage or injury arising from participation in this Event or from other activities that may be associated with participation in this Event. 

The Signee, on their own and on behalf of Participant (if under age 18), voluntarily agrees to assume and/or incur all risk of loss, theft, or damage of personal property and all risk of loss, impairment, damage or injury or whatever kind, including death, that may be sustained or suffered by participation in this event whether or not the result in whole or in part of the acts or omissions, negligence or other unintentional fault of Cape Hoops, LLC, including the organization’s affiliates, and all of their respective former and current officers, directors, owners, affiliates, agents, volunteers, employees, and attorneys (collectively the “Sponsors”). In addition, the Signee (including his/her heirs, assigns and personal representatives) agrees to release, hold harmless, and indemnify the Sponsors from and against any claims, demands, actions, causes of action, lawsuits, expenses or losses (including attorneys’ fees) on account of property damage or personal injury (including death) arising out of or attributed to the individual’s participation in the Event.
